“A federal appeals court on Wednesday threw out a lawsuit alleging that President Trump’s ownership of private companies that accept foreign-government business violates the U.S. Constitution.
Reversing a lower court, the Fourth U.S. Circuit Court of Appeals in Richmond, Va., ruled that the state of Maryland and the District of Columbia lacked standing to bring their claims against Mr. Trump.
“Word just out that I won a big part of the Deep State and Democrat induced Witch Hunt,” Mr. Trump tweeted in response to the court’s action. “I don’t make money, but lose a fortune for the honor of serving and doing a great job as your President.”
The suit is among several cases claiming that the president’s business interests run afoul of rarely litigated constitutional provisions aimed at preserving p**********l independence and curbing foreign influence.
The District and Maryland’s complaint alleged that Mr. Trump is receiving unconstitutional emoluments through his interest in the Trump International Hotel and related operations in the nation’s capital that draw money from foreign governments, state governments and federal agencies.
In Wednesday’s 36-page ruling, the appeals court ruled that the plaintiffs failed to show how the two jurisdictions and their residents were harmed by the president’s ownership interest in the Washington hotel.
“In short, the link between government officials’ patronage of the Hotel and the Hotel’s payment of profits or dividends to the President himself is simply too attenuated,” wrote Circuit Judge Paul V. Niemeyer, a Republican appointee.
Circuit Judge Niemeyer wrote that “there is a distinct possibility...that certain government officials might avoid patronizing the Hotel because of the President’s association with it.”
