It does NOT appear in any of my Canon bodies with pop-up flashes I use the polycarbonite hot shoe levels all the time, and my 30D, 60D and 7D (all with pop-up flashes) are unaffected.
I don't have a 40D, but... I think there is something else involved. I suspect that the cover used is conductive (made from aluminum perhaps) and it is fooling the camera into to thinking there is a flash of some design attached.
