This issue is specific to the terms included in an admission ticket to a particular site in NYC, "The Vessel" at Hudson Yards, but has broader application to other areas of photographic interest.
Apparently the ticket gave the property owner extraordinary rights to all photographs taken at or of the so-called sculpture.

http://www.nanpa.org/copyright-controversy/#more-19951Interesting, but, it was just a case of some over-zealous legal team writing impractical terms that were quickly changed. The moral of the story, as the writer states, is to always be aware of what you are agreeing to. That's always been the case.

What are the odds that a case this applies to goes to court?

http://www.nanpa.org/copyright-controversy/#more-19951The original terms and conditions only applied to interior shots inside the Vessel. After a huge quantity of complaints, some of which probably came from the city officials, the T&Cs were changed to give rights to any non commercial photograph taken in The Vessel to the Photographer. Unless images are posted on any on line forum or web site. Then The Vessel reserves the rights to use said photograph without recompense to the creator.
Better, but still shitty.
