There is the possibility, from the way the story was laid out, the she cancelled the check earlier on out of concern for a bounce while intending to provide a new check. Then she just forgot. Start with a gentle contact. People do strange things when worried about a child.

I agree 100% with this advice from DS Meltz and a few others.

Definitely start with GENTLE. There could have been one of many ressons for what happened so why assume the worst. A telephone call might work if you are comfortable doing that and keeping it light.

Later you may have to do more. If so you have only lost a little time (and kept your blood pressure under control).

Good luck!

Since this thread is more than 8 months old, it's probably all resolved by now.

If nobody has mentioned this, turn it over the district attorney for theft of services.

I talked to the local prosecutor and was prepared to sue her and charge her with Fraud. I let her know by certified mail what I was planning on doing. She folded.. wrote me a check for the full amount and that is that

I believe your only recourse is to first, call the woman and/or send her a letter asking what is going on; she contracted with you for your services at a set price which she agreed upon by sending you the check. At least give her a chance to explain what happened. Following that, if she does not pay you, your best option is small claims court as you have stated. Good luck.

Dennis

Dennis said it best. I would add that the letter be sent Registered Mail - Return Receipt, so can use it if you do have to go to court.

Amazing what the fear of the law will do.

What if you scanned her bad check and posted it on social media -- or at least told her that was an option.

I'm wondering how long this 8 month old thread will go on now that the OP has said it was already resolved.
