Virgina court rules photos are "factual depictions". Copying them is considered "fair use" even for commercial purposes...

Is there a workaround if posting a photo to the web? If someone takes it to use in commercial purposes, would saving it as the smallest size it can be (in terms of megapixels) make the its quality unusable for commercial purposes? How does a professional photographer advertise his/her work to generate more business? What would National Geographic say if someone copied/used their photo(s)? Does the fact that it is, so far, a court in just Virginia?

It was a federal court decision, so it certainly holds in the Virginia (Eastern) district the where the judge sits. I would think an appeal of the decision would go to the next higher level, the US Court of Appeals for the 4th Circuit.

This one may be worth watching.

Let's hope the Appeals Court brings some common sense to this case and overturns this ruling. Otherwise implications are profound.

Note that the Judges decision is under Appeal. Isn't this something that the PPA should be weighing in on?
