Looks like a Redtailed Hawk to me. Belly band and red tail feathers are the indicators. Does your neighbor have a bird feeder nearby? :)

no . no feeders anywhere nearby. but chipmunks and squirrels are quite abundant here.

Looks like either a sharp shinned or cooper hawk.
We found one watching our bird feeders and he looked similar.
Ours didn't look as ruffeled as the one you showed.
