Two or three weeks ago I was up at Winstar World Casino just N on the Texas Ok border. It’s the largest casino in the world. I asked security if I could go to their far North parking lot, where no one ever parks, and fly my drone out there to photograph the facility. Well the answer was a definite NO, They were nice about it though. Then he said “if you decide to go ahead and do it, at least please let us know as we could use the target practice”. OMG Really! Then again it IS on an indian reservation so they actually could get away with that. Needless to say, the Mavic stayed in my car. Being the serious photographer I am though, I’ll find a way to get that picture. Been spotting a couple of good locations that look like I can fly out of them. If so, I can be in and out before they know it. They’ll never see it. Pictures will be posted if and when I can make that happen.

I had asked about flying and shooting some video and stills over a Civil War re-enacted a couple of years ago. The person was really nice and said no because of worries about insurance in the case of an accident. She said if I had approached them a month earlier it might have been different. I had even offered to give them the digital files to use from promotions at no charge. Well, no big deal. I went over to the back side of a public park where I sometimes fly with other pilots. The re-enactment was just on the other side of a thin tree line. I went ahead and did some quick flights. I was at about 250 ft. and I doubt anybody noticed. If I had worked it out with the people in charge I could have flown a lot lower and got some good shots. As is, it was interesting but nothing great on the video. I think I might have posted it on YouTube. I'll check and send you a link if I find it.

NOT TRUE! I followed their instructions and did not fly off of their property. They said nothing about not being able to take pictures. Just not allowed to fly from there. There is no law against launching from another location.
Know what you are talking about before you start whining.
you asked if you could launch from their site. They said no. Did you ask if you could take photos of their property?

Yes I did and they did not say no so that is a yes. There is nothing secure about the outside of any building. End of conversation!

As you can see from my posts I was in a similar situation. I too was told I could not take off on the property and they could not sanction my flying and filming. Doesn't mean I couldn't take off from an adjacent property which was a public park. It's a bit of a grey area.

I agree that flying over someones property is very legal. The airspace is FAA controlled. Photographing someone's property, without their permission, is the very grey area.

The rules are very vague in some areas while the FAA decides how to handle "drones". The rules are very distinct in other areas. You don't fly around or through a major airport. You don't fly over the Pentagon or land on the white House lawn. I'm exaggerating a bit here but there are idiots out there who have done this. So it comes down to common sense which ain't that common anymore. I still say what I have done and Charles has done would be minor questionable events in a grey area. Just my $.02 cents worth that might only be worth $.01 cents or less.

I have a question that I guess I could Google but I think it's an interesting topic to bring up here. Concerning trespassing we all know property boundaries. But how far as far as altitude do property boundaries extend. If I fly over your house at 100 ft. I'm sure I'm trespassing. What if do the same at 400 ft. or more?
