Using another photographers photos

My daughter got married last Saturday down in Missouri. They hired a friend to take photos who wants to break in to the wedding photograhy business. I would have taken the photos, but you cant be mother of the bride and photograher too. So they paid her $50.00 with the understanding that i would get the disc to edit. She could use the photos to pursue her business, and i would get decent shots without the stress of trying to do both the meet and greet and photos.

Her shots turned out well, considering it was 110 in the shade of the park. It was a very small beautiful wedding, but now i feel kinda wrong using her shots. any thoughts on this? Is it wrong to do if we went in to it with that understanding? Comments welcome.

This is a very unique position and question. My thoughts are thus: If she took the shots you should not take credit for them even if you edited them. Not to imply that was what you intended but just exploring the possibilities this unique arrangement presents. What, precisely, does the understanding y'all had mean to you? And to her? You say she would take the shots and you could edit them, but was there any discussion or arrangement as to who gets credit/copyright for the photos? The best way I can see to address this issue with the information provided is a dual watermark; if one is to be applied at all. Or in the case of posting on a website or facebook page without any watermarks then perhaps a "credit" on the album cover such as Photos by Jane Doe, Editing by Sally Doe. And then of course this leads me back to the original arrangement that she gets to show/use the photos for her business portfolio - will that also be her photos with YOUR edits or with any edits she may do?

Thank you for commenting. I would not take credit for taking the photos. I would post them on my web site with my own edits, and giving her credit. She will do her own editing and post them on hers. It was more the fact that my daughter is very independant, and wanted to do things her way. She did not want a big fuss made over her, so she hired a photograher of her choosing so i could enjoy the day. I did try to take a couple of Photos, but the demands of guests and the heat did not allow.

I just am feeling a little guilty, but i just want them to remember my daughters special day. i would post them on my wed site only to show how beautiful she was on her wedding day, and how proud I am of her.

OK, Now that I have a better undestanding, I think your approach is good and well thought out and should be completely guilt free. In fact sounds like a win for everyone there. Well done for all of you!

Thank you, maybe it is more that i wanted certain shots that i would've taken, and she did not. Well, live and always learning! Thank you for your comments.

Sounds good to me. Agreeing beforehand is the right way to do it. She got paid, she got experience, she got the photos. You also got photos. Since you're not going claim that you were the photographer, there's no problem.

I wonder about the temperature ratings of the cameras and SD cards, though. 110 is awfully hot.

Don't feel guilty. This is a marvelous opportunity for this photographer to get a start and you like the photos taken. Process them the way you want and praise the shooter. I know a few weddings that have had this arrangement and all parties were very happy.

It was HOT, but maybe exagerated a little, I know it was over 100!! Thank you for taking the time to help with the delema.

Thank you tk, I am feeling a little better about the situation. Just wish i could've done both. But she did do a good job. I am attaching a photo that I took before all the festivities. And yes it is edited. She was really standing in front of a closet :)

Once you have that photographers permission, and give them credit, all is legal. This is quite unlike another poster who openly admitted he has used UHH posted photos in a presold photo book, without anyones permission. Thats a whole other story!

Yes I saw that post, something is for sure not right with his ethics. I have not posted alot of photos, so i do not have to worry about mine, but i do feel for those of you who did and had them stolen. That is basically what he did, and you wont even know if yours were unles you buy the book, and he profits!

did she sign a agreement to do so. and if you sell some of the shots give her a percentage of the sale. make sure you get a signed agreement.
