I believe that is an Eastern towhee, as cmc65 mentioned...definitely a pretty colored bird.

Since there are several birds with similar coloring etc it would help greatly if we knew where this is to narrow the choices.

OK while I researching and typing it was ID'd.

But when asking for a bird ID it helps to know where.

I agree Robert. The towhee is an example because there is also a western towhee that has slightly different markings.

I agee with the ID of Eastern Towhee. The western version does have different coloring. One of the characteristics of the Towhee is when it gets into a layer of leaves, it does a sort of kick/shuffle to stir up the leaves to look for insects and other possible food.

Ones that have the same coloring in different patterns and different beaks: 3 or 4 kinds of orioles, two here in southern California and the Black Headed Grosbeak and the Spotted Towhee here in the west.
We do have Towhees that look very different. The California, Canyon and Albert's Towhees are mostly gray or brown above with subdued color on the underside.

I've seen one Black Headed Grosbeak here in Los Alamos, NM. It's a right smart looking bird; almost looks like he's wearing a suit.

Hope it is ok to post a pic of our Western Spotted Towhee just to show folks the difference? If this is a bad breech of protocol I will be glad to delete it....I am in Oregon...and these are one of my favorite locals. walt
