Recently in Texas a photographer was holding a photoshoot on the railroad tracks. A train came, sounding its horn - the model stepped off the tracks - and right on to the adjacent tacks where ANOTHER train was coming, and she was killed. Sounds like a good case for manslaughter. And a Darwin Award, sadly. We have had discussions here before about the stupidity - and illegality - of being on railroad tracks. I feel sorry for the engineers, who have no ability to prevent the inevitable tragedy from happening right before them.

Very sad. The photographer, if he really was one, should have known about the dangers of shooting on tracks.

Manslaughter??? Dumb ass mistakes don't make for a criminal charge. Regrettably, this girl and her unborn child are dead. I think "Photographer kills model" is a bit of a reach. No one will know how persistent she was regarding the location.

No.
She should have removed herself from all tracks. The negligence is on her part.

Funny I thought it was a train that did that (the killing part)...

Gross negligence, yes. Do remember that instead of staying on the track she could have stepped out of them altogether - as did everyone else -. Darwin award winning decision here.

It was an accident. If he'd gotten her drunk or drugged her and then set up to film or video the event on purpose, then he'd be culpable. Under the circumstances given, trespassing perhaps. They both appear to be incredibly stupid or daring.

It doesn't matter how persistent she was. Railroad tracks are private property owned by the railroad and being on them is trespassing.

She/they should never have been on the tracks at all.

Yes. The discussion was the loss of life and criminal culpability.

On the lighter side. This brings up so many "train" song titles:

"Hellbound Train",
"Bound for Hell",
"Don't Miss That Train",
"Runaway Train",
"Chattanooga Choo Choo",
"Asleep at the Switch",
"Bound for Glory",
"Chicken Train",
"Driver 8",
"Funeral Train",
"Crazy Train",
"The Coroner's Footnote",
"Cross the Tracks (We Better Go Back)",
"Cross-Tie Walker",
"Devil's Train",
"Different Trains",
"Texas Silver Zephyr",
"Tons of Steel",
"Train Kept A-Rollin",
to list few.

Trespassing is criminal, so her persistence is irrelevant.

The point is the loss of life. We have over 11,000,000 illegal aliens. That's trespassing. That's criminal.
