For all those Constitutional American Patriots® out there harping that Hillary is going to repeal the 2nd amendment, here is what's required to repeal a constitutional amendment.You will notice that the president has NOTHING TO DO WITH THE PROCESS.


Article V, US CONSTITUTION -

The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress.

It takes 66% of the entire Congress, or 66% of all the states, to propose an amendment to the US Constitution. THEN it takes 75% of all the states to agree to the amendment to the US Constitution.

But go ahead and keep LYING that Hillary is going to repeal the 2nd Amendment! Just like you LIED that Obama was going to repeal the 2nd Amendment!

No, a president cannot repeal or amend the Constitution.

But by picking the "right" people for the Supreme Court who will rule from beliefs/politics rather than the Constitution itself the same results can be achieved.

A "de facto" repeal/amendment rather than a "de jure" repeal/amendment.

The only thing stopping that is a Senate which refuses to confirm those nominations.

For repeal you are correct, however a supreme court ruling has the effect of law, A justice who believes that the Constitution is a flexible document can rule that the second ammendment OONLY applies to a m*****a and that a m*****a is in =effect an army. And that as average citizens are not in the Army they have no right to bear arms. And therefore all the arms in the possesion of citizens not a member of the armed forces must turn over all arms to the federal authorities. The supreme court has the ability to negate any constitutional guarantee it wishes. The court after all, in it's decision to uphold the ACA mandate for the first time gave the congress the right to tax a non activity. Don't buy health care pay a tax. As a result the Congress canpass a law which states- Don't grow corn- pay a tax. Don't but an American made car -pay a tax. In fact the framers did not give the Supreme Court the power to overturn ANY law. That power is reserved ONLY to the congress, by repeal. The Court TOOK that power in Marbury v Madison. No where in the constitution is there any mention of the Court having the ability to rule on ANY law. I suggest that you actually know the constitution before making incorrect statements about it Another thing about the constitution and the laws of the US. The president hasmany powers not granted to him in the constitution. Through the powers of regulations, he/shecan put any industry out of existence. The automoblie industry could be k**led by EPA regulations, all cars and trucks MUSt get 50 miles/gallon. Such a regulation would effectively k**l the car and truck industry. It need not be a law, but it has the effect of law. All businesses with more that 2 employes MUST provide health insurance. All restaurants must privide seperate bathrooms for 25 seperate categories of patrons. That would end the restaurant business--as absurd as it may sound the president through one or another agencyhas this kind of power. As commander in Chief the president could stop ALL Navy shipping and ALL nNavy ships by calling on the EPA and regulate the polluting nature ofall Navy vessels. Again absurd but the president has that kind of power through regulations.
