I do not know what to think.
#1 a tourist snap of a tourist snapping.."street?" Naaaah.
#2 an image documenting a highly imaginatively creative effort to dress a part of the environment in such a way that characterizes that patch of "street" So yeah, I buy it as "street"
#3 a badly overexposed tourist record snap intended solely to confirm "I was there"
My opinion, of course.

There was no question at all about who owned what, and that the use was absolutely legal. Get over it Graham, you were finessed.
Quite, absolutely No Question who owned what, is there.
You are not denying that you took Grahams image without permission. There may be provision for fair use for you to hide behind in American law. There is no such defence in British Law. Fair use doesn't mean you didn't infringe Grahams copyright, either.
Surely one photographer should respect the copyright of another photographer. Very hard to be respectful to someone who has behaved as badly as you have. You should resign if you had any honour at all.

I wasn't aware of that. So is it copyrighted if you take it or is that a process one must employ to secure copyright. I don't have any idea who is right but I tend to side with Graham on this one.
No one should do anything with another peson's work without permission - copyright or no copyright. It's called being considerate, and, like you say, honourable. My daddy told me long time ago at nudist camp, "Son, there is no honour among thieves." Never forgot that one and have heard it repeated millions of time since.

I only mention that because some naughty little girl stole my slippers and I couldn't walk very well without them. Not that a little girl has to worry about honour - but I was really pissed. (Ooops! Is that a no-no word for the forum?) The first time anything was ever stolen from me.
