Another win for someone wrongfully arrested for photographing outside of a military base

The article is kind of sketchy on details, but it appears this poor lady was arrested for photographing a static helicopter display outside of a military base. Worth the read.

Nancy Genovese spent four days in jail, was allegedly strip searched, posted a $50,000 bail to get out, and was charged with misdemeanor trespassing — a charge that was dismissed in November of that year.

Genovese may end up being compensated more than the $1.12 million awarded by the court so far. The jury decided on that amount for compensatory damages, and has yet to decide what to do about punitive damages.

This one at face value calls for an apology by the arresting police. No more than that.
And only if it is found that she was cooperative all the way and the area was open to the public.

Hahah...jailed, strip searched for 4 days and an apology?
No thanks.

I'd bet a paycheck if you got strip searched, let alone jailed for a week you'd want more than just an apology.

I tend to agree with you but I doubt that we have been presented with the whole story. Sorry, just a gut feeling that something is missing.
I be damned if I judge without all the facts.

Over a million dollars for damages? Seems a bit excessive, despite the obvious injustice she had to endure. What sort of damages did she experience that would require a million dollars to restore her back to normal? I'm not suggesting she doesn't deserve compensation, but it should be a reasonable amount. Ultimately, it will be the taxpayers flipping the bill here.

Did a Google search on Nancy Genovese. the 1st result that popped up was: http://www.murthalawfirm.com/nancy-genovese-lawsuit-updates-town-southampton-default/. The city attorney is apparently not very competent.

An arrest with the term "Terrorist" in the record, even if you are acquitted, will follow you for the rest of your life. Good luck if she trys to fly and discovers she is on the No Fly List.

$1.2 million is minimal compensation and "sends a message" to over eager undertrained Police.

Juries like to give big awards from insurance companies and the government. They don't care that it's the taxpayer or the policy holders footing the bill.
Most military bases have signs no photographing, which I agree with. Like one of the previous posters said, we don't know the whole story. She may have given the police a hard time. Just because she is on public land doesn't mean she can take photos of military bases.
In a middle east country she may have been shot or in prison for years.

There is more to this story than that article indicates. I know Lt Iberger personally and what is not mentioned is that this lady had numerous guns and ammunition in her car(not illegal) which raised his suspicion. She also was non-cooperative and belligerent(again, not illegal) which tends to upset peace officers.

Juries don't set the compensation amount. The prosecuting attorney makes the request, and the judge makes that final decision on the amount.

Interesting story. I have tried to find out the final resolution of this event but all I have found is that the officer got to retire with a considerable sum and the town was still fighting the suit and that was in 2012....does anyone have any other info....????

The case is under appeal and is still pending!

Thank you nimbushopper. As you know the officer in question and he is apparently now out of the suit do you know if he actually told the lady he was going to arrest her to teach right-wingers a lesson ??? In full disclosure here I consider myself moderate on most issues and am definitely not a winger of any sort, just a curious old soul seeking the truth.
