Hi guys.. I'm interested in doing street photography and people on the street kind of stuff.. do I need to get people to sign form after I take picture if I plan to post it publicly?

Technically, No!

If it's in a public place (street) then there should not be a problem.

In a store or the like, then you may meet some objection from the owner/s. Just move on, there's always somewhere else.

More pertinent is taking photo's of children. You may meet with some objection from parents - so ask first. But a general photo of them in a street, taken from a distance, should pose no problem.

If you are selling for profit, then yes you need a release. If you are just shooting to shoot or for practice, you do not need one. But it is better to ask permission.

It seems the the laws are changing almost daily - I would check with a local lawyer who specializes in this line of work - they should know the community attitude about photography - better to spend a couple of $$ up front than fight a lawsuit

My .02 worth..

There are many forms on the web you can copy an Stock Photo site and personalize. The Very best option is to consult a lawyer in your area and pay them to do one for you. Of course they cost money. Just Google Model release and you will get a ton of hits.

If you can, ask for permission first. Especially with children, otherwise everyone thinks you are some weirdo/pervert. Plus, people appreciate being asked for permission and relax. Mostly, don't need a release but varies from state to state, so keep a release handy if you think you might want to use a particular pic for any commercial purpose.

just one more question.. are you guys familiar with the site: Humans of New York..

Photographer stops people.. gets their stories.. puts it on facebook... I asked him if he got permission but he never got back to me.. would that be something you think that would need permissions?

Not familiar with that site, but I would say if he is stopping people and talking to them, then taking a photo, permission is implied. I would still get a release if used for commercial use.

What you may not know is the way some do it, is ask for permission to take the photo (get no release) Give them your website offer a free web-quality download to them, but at that time have them fill out the release before they can download.

I think it is better to get it up front unless you tell them to go to your website to fill out the release and then they get a free copy.
