Do you need permission from people in your pics?

I'd like to know if you need permission from people who are in your pictures, if you are using that picture on your website to promote your business? I'd like some feedback?

Yes. Let me add you need to get photographers release and if they won't you don't use their images. If it's people you cannot contact I would'nt suggest you use their images to promote business. L3

Hey Hoover... I believe the stipulation is if you are going to use the photos for commercial purposes, i.e. in an advertisement for a product) then you absolutely need a model release. If you have an iPhone, there's a couple of great apps that have photographer model releases. They can sign on the phone, snap a shot with the phone and their picture is included with the release and they will get a copy of the release sent to them in an email... and to you too, for your records. Now the gray area is... are photos I use on my website to promote my business considered commercial... or street photography for a book or show... are they considered commercial or recreational? I'm not a lawyer and I shoot both. I always get my in studio, headshot clients to sign a release... always. But when I'm on the street, unless you have a couple of assistants chasing people down to get releases, it's nearly impossible. On Kelbytraining.com there is a class just for this purpose. You can get a free trial and check it out. Good luck.

For everyday type shots, no permission is needed... Commercial pics as Jamie said - Yes....

If you plan to use images of people (no matter where and under what circumstances you photograph them) I think a lawyer is the professional to consult with this question.

So you're saying if I have a website that I promote my business and show pictures (that I took) of the work I do, that means I have to get permission from the individuals?

I don't photograph people because of a situation in Toronto where I was offered a choice, erase the pic or you'll meet my lawyer. I checked with my friend, a pro with his own shop and does contract work and basically, legally @ 100%, you need a signed permission. However, if you're on a topless beach...well you're in trouble, if you are at a NASCAR race, no problem.

(No I never did the beach thing, but NASCAR yes.)

You're getting a lot of misleading information..

The answer is generally, no... you do not need a release or permission of individuals in your photos to show them or have them on your website.. There may be exceptions, but they would be rare..

If you want to sell a persons image for a profit, and that person has "posed" for you or is the main subject, you may likely need a release (but not always).. If that person is incidental to the main subject, you do not...
