Well, this is a rather oversimplification of both the incident and lawsuit.

The lawsuit was dismissed because it was determined the NYPD officers do not have a "special duty" to protect individuals. For example, they are not required to die for you because you are in danger. At the time of the incident, the nearby officers assessed that the risk to their own lives to intervene was too great. With that assessment, to halt the stabbing would have been an act "beyond duty".

It is sad when the police watch a crime in progress.

Perhaps.

In their report, the police officers claimed they believed at the time that the stabber had a gun. It is very possible that they were under strict orders to avoid a shoot-out in the busy subway station - for obvious reasons.

One of my close friends is a policeman stationed in the subway in the city I live. According to him, there are rules when he can draw his gun while in the subway, which are very different and much more strict than when on patrol out in the street. Not only is there the very real danger of bullets injuring and killing innocent bystanders in the crowd, a mass panic rush to the exit can lead to additional deaths.

Of course it is also plausible that these officers, in their defense for inaction, simply lied about believing the stabber had a gun. Then yes, they are cowards. But only they know the truth.
