HI, I'm new here, a friend showed me this forum and it looks great, lots of neat pictures and knowledgeable people, and I am looking forward to learning lots! :)

Hey SNOWBALL! I know you will love it here. There is more beauty than one can see without being at the computer waaaaay too long, but you can post some of your beauties here. You have a lot of beautiful things to see up there, your landscapes, birds, dogs. I'm so glad you are here.
Jo

Thanks Horseart, I am enjoying looking around. :) I'll have to get posting some more pics soon. :)

Not that it means anything at all, but I never had a smoke nor a sip of alcohol, and at 74, no telling what it would do to me now, huh? Top of my head might land on the moon. Hahahaha!

You know, if I knew I'd never go in there again, it would be no loss to me to calmly say, "I came here to purchase something, but you just made sure I'll never come here again."

When my house burned in 1987, I went to a place to get new EVERYTHING for my new house. I asked the store for a catalog so I could go home and look through and order everything from tablewear to furniture, appliances...(what wound up to be $67,000 worth of houseold goods.) The guy behind the counter told me he would SELL me a catalog. I explained that I always bought everythng from them but my FREE catalog burned in my fire and I thought that if they would be nice enought to supply me with another, I'd buy everything I need all at once (insurance was paying so.....)He said "Sorry, I can't GIVE you one. That will be $11.95 for a new one." I looked at him and said "I can buy everything I need without YOUR catalog" and turned to walk away. He called out and said "Wait, lady, let's talk about what all you might need". I said, I told you I need everything one puts in a home, but you are too late". Out I went. Sheesh!!!

Having just finished discussing this with my better half, who just so happens to work in Business Litigation and IP law, this is very misguided advice, at least here in the USA. Most Federal courts will not even hear a case claiming infringement on unregistered work, in fact, in some cases, the courts have actually made the claimant file to register the copyright before they would even proceed--copyright is Federal and most Fed. courts don't consider unregistered copyrights as being in jurisdiction, and that is the first motion to dismiss that the defendant will make. Each separate motion brought before the court, any of your claims which are contested, any of your evidence which is challenged will cost you money to argue. Registered, there is not much that they can challenge or argue.

She also looked, and can't even find a case, in the history of the America, where any real damages have ever been awarded without a Registered Copyright claim. She did find a few where $1 was awarded, just basically showing that the copyright was probably infringed, but no actual damages successfully proven.

Registration is required to claim statutory damages in US courts as well as to force the thief to pay the legal costs to prosecute their infringement. Typically, the majority of Registered infringement cases are settled out of court because the defendant is essentially going up against the word and statutory laws of the US Government, where they know that they will likely lose big $$$ in both court costs and awards. The main benefit to registration is that you don't have to prove any damages, they are statutory, unregistered you have to prove actual damages, which is pretty tough and very expensive.

THAT is why we use watermarks. It's cheaper and easier to just watermark a photo rather than try to register each one. Plus I'm sure there is a cost involved with each registration. The government gives you nothing for free except grief. I think it's sad that someone can steal your work and if you haven't registered it, you are out of luck if it gets stolen. Yet if I publish a paper and someone doesn't properly quote me, I could go after them for the theft of intellectual property. It just doesn't make sense. I have heard someone say once that the reason is because the person who stole your pic could go to the exact spot where you took it and take the same photo. And I would agree with that IF they knew exactly where to go and exactly what time of day it was taken, and even the angle of the sun would change if it was shot several weeks later. That is why when I post a photo anywhere, it's NEVER the full resolution copy. I resize it down to about 100kb. Try enlarging that to anything bigger than a 4X6 print, and you'll see why I do it.

Your pictures are never safe anywhere, but if someone wants to copy it and then sell it as a print or as a card, anything at all, you own the copyright and it can actually cost them the farm if you press the issue in court.
A poor man's copyright can make you rich if someone uses your photo for ANYTHING. Take the photos you think the most of, make a copy with a date on it, take it to a notary, sign it, have them notarize it, seal the envelope, take it to the post office and have them HAND CANCEL it, so you can read the date clearly. Then mail it to yourself. DO NOT open the envelope, file it away. If someone starts selling your photo, take them and you un-opened envelope to court. Show the date they were selling it and let the judge open the envelope and look at YOUR date! They are now TOAST! They will pay you big
bucks after the judge figures how many of these you might sell in a lifetime. They have infringed upon your living! I know this. Read the book of copyright
laws. I do all my painting this way.

Gregory, you are absolutely right! You ARE the author the moment you click that shutter button, but it may be a little harder to prove it that way.
Most people never feel they will have to prove anything because so many do not seriously paint or take photos to sell, but I do. I had a lady to copy something of mine once. My attorney wrote her and told her she could give me her beautiful farm if she continued to copy. She quit.

Have you been in my back yard? I have both of those in my yard. I don't know what the big purple puff ball is but the other one looks like chives. Anyone know what the first one is?

John, that's not my photo, but I know the big purple puff ball is Allium, some grow as tall as 3 to 4 feet and some even get the size of a baseball. The purple ones are nice but I want some blue ones! They also come in pink, pale lavender and fuscia.
