And he is completely wrong about Lee.

Taking up arms against your own country marks you as a traitor, and no amount of previous service negates that.

Then why didn't Lincoln have him tried as a traitor? or charged even?

There's a line in one of those national treasures movies that sums up the situation at the time. Before Lincoln "the United States are" and after the civil war "the United states is". We went from plural to singular.

What does that mean? Ask an actual historian. But if you ask me it meant that state and local government was the seat of power and the federal government was not. When Lee obeys the ruling of his state, Virginia, which elected to become part of the confederacy he was doing what nearly everyone would do at that point in time.

There were a lot of important things about the Civil War. Slavery was only one of them.
