I know but that is how it is. Although the court didn't deny that the monkey was the photographer they denied his right to the image. I guess it's like Paul said, the monkey took the picture but he couldn't take picture out of the camera and he didn't own the camera.

I almost always tripped the shutter for every money maker shot in studios where I was NOT the head photographer on the scene. Once the polaroids (also my job) were approved by the AD, it was my job as underling to run the film holders thru the camera and stick a fork in it.

Its typical that the head photographer is NOT the head shutter clicker. The monkey is just a low paid assistant.

Another discussion that is about as popular as a "turd in a punchbowl". Once again we are working on "How to take the joy out of photography"

Notice how people have found so many ways to do so?

SO glad I don't worry about some of the crap that many worry about.

If you have to shoot RAW so that you will have the most latitude in post processing, you are a computer graphics bubba, not a photographer.

And if you don’t understand why real photographers shoot raw you’re an uninformed, narrow-minded curmudgeon.

It ended in a settement and the guy whose camera was used by the monkey agreed to donate 25% of his sales to the group that protect animal in Indonesia. So the camera is worth 75% of the image. Not so much the 12 inch behind or in front od the camera.
Of course that is because the law was made by human. If the law was made by monkeys it would totally be different.

A monkey would never sue over rights.
