Never use Fed Ex again!

I worked in shipping for over thirty years. In a nutshell, hate Fed-X for multiple proven reasons and won’t use them if there is so much as a horse available elsewhere.
They owe you postage and repair costs, replacement if it can’t be fixed. Good luck. Most likely you’ll need it.

I can see the repercussions already. Their stock dropped $0.05 over the last day.

They kept the box for evidence and a note on the acknowledgement said "Please note Lens was damaged by insufficient packing". I had left the UV filter on it and it was also shattered. Tamron assessed the damage at $278.00 to fix which of course I told them to do it. I want my lens back! It's bird season in the RGV!. I have filed a claim on 12/3 and have not heard anything yet. My question is should I make them pay for the lens and filter or settle for the amount it takes to fix it? Comments please. Again sorry for the lengthy post.

I have a feeling you are going to have to hire a lawyer. All the delivery companies will give you the fool's run around until an attorney contacts them.

Whatever they will do. And I would file a complaint about the clerk who talked you out of the proper packing of the lens. Hopefully you have his/her name.

I guess it depends how you approach it. I've had tools, large and small show up damaged. I few times it was damaged photography equipment. Once it was 100bf of lumber that an oil drum leaked on. In every case the items were replaced with a phone call or two and maybe a photo.

The key is to stay calm, explain your problem, and be polite.

At the store it says ,"you break you pay."it's like OnDSnap says,"whats the insurance for.let them keep the lens and pay you $1100.if you had your engine burned up and it had insurance on it would you settle for an overhaul or a new engine.i once loaned my camera to a friend and he removed my expensive lens without pressing the release button. He did pay for the damages but my lens was never the same.good luck.

FedEx is good except when they are not! I had medical supplies sent while vacationing in the USVI. Long story short: they traveled around on a truck for days, undelivered. In even saw the truck in front of our vacation condo but they failed to deliver. Went to their shipping depot - no dice. My conclusion was it was the fault of the delivery truck driver.

I don't trust FedEx. I have received no less than 4 four packages that belonged to other addresses. When there is a problem you can't talk to a live person, they rely totally on AI. And if you don't have a round plug or square one to fit in there system holes you are out of luck. I also had a package lost by UPS but I went to store from which I sent it and they followed through personally as well as calls from UPS confirming they were working on it. It took a few months but they sent me a check for the shipping plus $100.

Just a thought, I have insurance too and may recover monetarily but that doesn't mean I won't have time and emotional lose which is what we all want to avoid. Just my opinion.

I find the drivers are constantly being replaced. Always with a young driver. The new young driver attitude is "I'm getting to the end of my shift", and will skip making deliveries. Many times I get an email that I have packages "on the vehicle and out for delivery" and no delivery happens. Often the same scenario plays out the next day. It is getting to be more of a problem by the day. Now next day means, likely three. Wonderful...

FedEx Ground is where they have the biggest problem. These are independent contractors who work with little or no oversite. I asked one guy why when it says 'out for delivery' I sometimes don't get it for a day or two. He said he may load his truck and call it a day without making deliveries.

My nephew owned a route for a while and gave it up. He said it all looked good on paper, but then reality set in.

A cardinal rule of shipping is never to accept a package with visible damage. Tamron should never have accepted your package. Even if they did, once they saw that it was damaged, they should have left it unopened exactly where it was and notified the shipper to come retrieve it. Once opened, it is no longer evidence of anything to the shipper or the carrier. It could just as easily been damaged in their operation or because of improper packaging. (The guideline is 4 inches of tight cushioning on each of the 6 sides.)

Tamron also has no responsibility to you. They directed you how to pack it, and for whatever reason, you chose to do otherwise.

Finally, there is the problem of "Insufficient Packaging" being noted on the acknowledgment. That was done by Tamron to protect themselves, and was a wise and very effective move on their part.

You can certainly pursue this case, but it is extremely unlikely to go anywhere unless someone is struck by an overwhelming attack of goodwill. No one has any legal obligation here to fix anything for you.

My suggestion is to pay the $278 and take this as a painful but beneficial lesson. Next time, pack as instructed by the consignee. Ignore any instructions given to you by someone with no knowledge of the item being shipped. If you had packed as Tamron instructed, you would have a case with them.
