I have acquired the original b&w negative. The (female) subject is now a movie star. The photo, a nude, was made in 1985 when the woman turned 19. (Well before she became famous). Along with the negative, I also now own the model release and copyright and any other rights.

I would like to make some bucks, but this situation is new to me.

- Limited edition prints?
- Screen image onto T-shirts?
- License image for posters?

I’d appreciate suggestions, and pointers to useful articles and sites.

Note: I do not expect opposition nor cooperation from the celebrity.

How? blackmail. Why would you want to do that?

Personally I'd return the negative to her and offer to return the rights for nothing, or at least a minimal fee.

Doesn't anybody have any integrity these days?

Consult with a lawyer to ascertain your legal options and potential liabilities. Then act accordingly. There is nothing wrong with attempting to make a few honest dollars.

Come on Pete. What’s wrong with making a few honest bucks? It's all a question of how one handles the situation. I don’t see it as an integrity issue.

Since there is a model release, this could have been a professional shoot she was paid for, intended for a mens' magazine or some such, in which case the woman wouldn't have much of a case. But if the OP bought the neg and rights, the person who sold it might have made the smart money.

That's fair enough, but I wouldn't personally wish to exploit a model without his or her permission. I have a number of nude photographs of people, and others in circumstances that they might no longer wish to be public, and I would not want to publish them without their sanction. With permission it's easy, or with an agreement about how publication is managed. I especially would not do that with someone that could afford expensive lawyers, even if my situation was legally sound. There are better ways of making money.

Well my first response to the OP was to seek legal advice. One can handle this situation so that it is a win-win.

But a win-win for whom? The OP's post didn't seem to indicate that the subject has a voice in this issue, he was behaving more like a predator. It the subject is a celebrity as indicated, why not negotiate with his or her agent discretely? Maybe a mutually beneficial arrangement can be achieved?

It could be a great image that both sides can profit from. If it is mutual gain, then it is fine. If it is exploitation, not so much.

Would you appreciate your nude photo, legit or not, exposed years after you had it shot? Be a decent human being and send the photo and negatives to the person and let her keep the situation private. Only someone very unethical would exploit this situation, just my opinion, but no amount of money would justify the embarrassment you may cause.

It's fine by me if the OP wants to do so but please don't ask us how to do it. We don't have the same idea like the OP.

Expect a lawsuit. Releases are not transferable as far as I now.

Yeah, that's a questionable situation. Was it legally transferred to the OP?

"Model agrees that copyright, moral rights, and all other intellectual property rights to the Photos belongs to Photographer and/or his or her heirs, licensees or assigns, with full right of lawful disposition in any manner."

http://dpanswers.com/forms/contract_tfp.html

This is the type of scandalous situation you see on TV every so often. Pictures of nude celebrities have the potential to generate income and ruin lives.

I have photographed many young ladies nude and have signed model releases to go with them.If one of these ladies were to become famous I wouldn't consider trying to make money from these images. Legal maybe. I consider breaking a trust at this point. When I decided post any these images in art shows I always contacted the model before hand if they had any reservations due to changes in their life I didn't show the image. This said I have only had one model ask me not to post images, I honored her request. What the op is asking,Wow that's just wrong.

Is she currently or potentially running for congress? She might want it published. On one hand she'd become a "victim" to some voters and on the other she may pick up a few admirers. Whether or not she minds it being published the National Enquirer eats this stuff up.

Just because something is legal to do doesn't make it the proper thing to do.
