Frank, it is amazing the Liberals have such short memories. Democrats did the exact same thing to Republicans a while back when they held up a a Republican nominee. Don't any of you look at the shit your own party squeezes out?

Your right Dennis obstruction has come from both parties, just not at this level! Republicans even voted against their own bills when Obama put them up. Democrats might even do the same thing if they had the chance. I don't put either party above that. The problem is the GOP is on the wrong side of history right now because the radical right took over, alt-right as an example! The other problem is the White Supremacist groups think they have a spokesman in Trump which empowers them. You can see that here on UHH from the extremist on your side. We both know who they are! Look at the nasty Racial comments on the 1st lady. Very sad.

It's amazing how quickly all of you got away from the initial post. boberic is right. This is the key issue in this election. Is the Constitution a living breathing document or is it meant to be taken literally as written.

According to our founding fathers it is meant to be taken literally and they made sure that everyone had the ability to understand exactly what their intent was by writing exhaustively about it. Some of you may well want it to be a flexible breathing document. That is your right. Unfortunately if we move that way any farther the constitution as we know it is gone. Once you start making small changes the whole thing eventually erodes away.

As far as the red herring about not having a vote on Obama's latest appointment the Republicans are just doing what Joe Biden and others proposed doing during the Bush administration in the event that he had the opportunity to make an appointment in the last year of his term.

It's not a new strategy or a new idea, and the consequences of a vote in this case are quite extreme. What if Trump does end up winning and we were still stuck with a court with five progressives on it? Good bad or indifferent the winning side should get the appointment, not an outgoing president.

Scalia's death was a national tragedy. He may have been the last great bastion of freedom in our country and at least our family mourned his death. Not taking the time to choose the next supreme court justice carefully would be bad news for our country. Not to mention for those of you trying to cite the constitution saying it is their constitutional duty to vote on Obama's appointee, there is nothing in the constitution that says how many supreme court justices we must have.

GOP is taking a huge risk with this. If Hillary wins, she'll pull this moderate's nomination and load up a string of libs. Be hard for the Senate to stall for four years.

Worse, should the dems win the Senate back, it will be a liberal field day. A couple of retirements or deaths, and who knows how constitutionality will be interpreted. could impact the country for a very long time. All the current conservative justices who might would think of retiring in the next four years will need to hold their jobs till they lose breath.

If Trump wins, the gamble may settle OK. But then again, who really knows what kind of nominations he'll make. I know he put out a list, but he is quite unreliable and flip flops about, based on his mood that day maybe...

Your analysis is correct other than the fact that even if Obama's nomination is a moderate, which I don't believe he is, it still would swing the balance of power on the court for years.

The Republicans are taking a huge risk. However, as a conservative I don't see a lot of other options. I don't want to see progressives in charge of the court and ignoring the constitution like the three that are there now already do.

And I also agree with you about Trump and being unsure what kind of judges he would appoint. His past stances and where he has put his political donations make him look pretty liberal, so I don't trust him either.

Good post. I know that we are on the opposite side on most issues, but I totally agree with what you said here.
