In this specific instance of the Iwo Jima image the copyright was renewed by Associated Press. The image is not in the public domain.

OK, I have changed my signature line giving credit to Joe Rosenthal. I hope everybody is happy, but truth be known I wish I hadn't started this thread. I posed a question regarding NG and Popular Photography images I used as screen savers, and unfortunately it digressed to my avatar.

someone probably said this already but I lack the time to go thru 6 pages.
on most social media platforms and forums the photog signed terms of use/terms of agreement
which allow the platform rights of usage for ever, in other words the photog already gave up some of their rights
of ownership. To use an image for your personal use is a given.
to try to sell it is a whole other story. It is kind and thoughtful and maybe even complimentary to ask, but
you will not be breaking any laws if you download a pic for screensaver.

I think you did the correct thing. It shows respect and awareness, it may even serve to educate some people. Educational use of copyright material in a limited way can be considered fair use, so I doubt you will get into trouble.

Once again, I apologize if I caused you any discomfort, but your question did open a can of worms unfortunately.

When I see a photo I want to adapt to cross stitch, I always ask the photographer first! And they always tell me yes, just to give them credit for the photograph. Which I do. Seems only proper. Especially since I only do this for myself. I don't sale these patterns or share with anyone.

If you don't want your images used for commercial purposes.....downsize them before posting on fb or uhh so that they're not good enough to be blown up and hung on somebody's wall, yet sufficient for the purpose of being seen on computer. If the young lady had done this, her client wouldn't have been able to get a usable copy to blow up to any decent size.

Had the young lady done her "due diligence" or even cared, she would have checked the law before breaking it. Maybe she did and decided it was inconvenient to follow the law. And besides, who would notice? After all, the only reason we have laws is to give lawyers a way to earn a living, hmmm? Well, maybe someone will send her a cease and desist order or she will get fined or fired for exposing her real estate firm the possible lawsuits and harm to their reputation. Sure, no harm, no foul.
