A falcon, I think. I say that only because I saw a falcon at a show last weekend. The falconer had a Lannier Falcon, native to southern Europe and North Africa, that looked something like this guy. Perhaps he is a Prairie Falcon.

You can't rely on the internet when it comes to hawk identification. The bottom photo is a falcon, note the under eye markings and the long slender wings. The Cooper's has short broad wings.

My first thought was red-tailed hawk. This spring and summer we had a breeding pair return to our neighborhood. They've been coming for many years. I thought they might be Swainson's Hawks, which live in this area but never could confirm it. Here's a picture taken from about 400 feet away. It's a long shot with a 600mm lens on a tripod but the thing is I don't see the yellow on the beak like your example for what that's worth.
