Seriously, pull your car onto the shoulder of the highway as far as you can from the roadway for your safety.

I say so because I've many times seen cars pulled off the highway only enough to get the wheels off the pavement. Then, opening the driver door opens it into the traffic lane. A person standing between the car and the highway also edges into the traffic lane.

I agree with the opinion that if a subject remains visible from the highway, then you may take its picture.

Of course you can .... for personal use. As long as your not trespassing

But if that horse is Justify hanging out by the fence.
You cant sell the photos to an Ad agency to advertise Victory shoes.
Then you better have a release from someone and permission

One call to the police would trump all our guesses! After all, we are not going to help you pay the ticket! I remember the parkway has signs that say something like "emergency stopping only" but don't know about the state highway.

That is true but don't we always risk someone asking what you are doing every time you put a camera up to our face?
If I passed up every shot that the police would come up to me and ask ......I would have to be a Studio photographer only.

Common sense a good story and a pleasant friendly smile is all part of the hobby.

Go shoot the horse. Maybe the owner will invite you in to photograph the Barn as well?

I used to see all of the hawks as I drove! Also cows, street signs, people walking....

But since my ADD diagnosis and time released Ritalin I keep my eyes on the road muc... ohhhh what was that ! A kestral! wow!

I have done that many times here in Florida. As long as you stay off private property and don't interfere with traffic there should be no problem.

If it is legal to stop on the highway, then definitely, yes.

I think we might still be on eight pages of a similar topic from yesterday. Don’t be amazed if someone tells you, definitely not OR yes/no/maybe.

Here in FL our bug eyed hyper Republican Governor made a law that said you could not even take photos of Oranges ... even tho not trespassing on the property. Declared unconstitutional. Suggest putting you hood up...

With this country going absolutely insane to be "Politically Correct," pretty soon just owning a camera will probably be a class 1 offense, punishable by life in prison. And if you have two or more cameras, you will be exiled to the maximum security prison, Pelican Bay, in California.
It's no wonder the world is laughing hysterically at the U.S. of A.
