A federal appeals court shoots down the FAA’s drone registry requirement

The court argued that the drone registration database violates 2012’s FAA Modernization and Reform Act, which states that the body, “may not promulgate any rule or regulation regarding a model aircraft.”
This will be interesting - if the final results are that the drones are considered "model aircraft", does that mean that there is no FAA penalty for removing them from flying over your property by any means you wish to use?
Will be fun to watch the arguments presented to the courts over this...

I have to wonder about the court's intelligence. A drone, especially some of the higher end ones are no model. A model has 2 legs, 2 arms a body and head.
Ok. To be serious, models are something you build from scratch, assembling the parts. If the drones are toys, then somebody better start passing laws to clearly define what a person can and can not do with them. Otherwise, someone could fly it around an airport as long as they did not disrupt air traffic. A person could fly it over my property and I would not be allowed to do anything about it. (Wanna bet!!).
I hope the higher court's overturns this ruling.

Its all in the eye of the beholder, lot of people call their sports cars -their toys (or aircrafts), I call all my cameras toys, as I do my raft, etc., because that's what I like to play with!

That may work between you and I, but we are talking law. If we consider our boats, snowmobiles toys, then they would not need to be registered.
I see you point, but we are not talking slang in court I hope.

Drones are different ? No . Both can injure people if flown in areas that have a lot of people . Look what happened to that little boy in Ireland , he lost an eye due to some idiot flying his drone . Drones are not toy models . They are flying aircraft . They then should be required to be registered with the AMA ( Aircraft Model Association ) , have their users be required to purchase insurance and only be allowed to fly in designated areas .
So they are exempt because they are high tech toys with cameras ?

I recommend summer reading "The Ultimatum" by Dick Wolf. Discusses use of drones as weapons of terror. It came out in 2015. Now ISIS is doing it in Mosul. Won't be long before they try it here
