I believe when you post an image on Facebook, the image is the property of Facebook from then on.

This is why I don't post my best work online. The ones I don't want used by someone else. Not on FB, not here or anywhere. Sounds awful, but I'd be very upset if I saw something obviously mine claimed by someone else.

If you are not looking to be compensated and the organization in question is recognized as a non-profit charitable organization, at the very least they should give you a charitable donation receipt for the fair market value of your art.

They make it clear that you own your photos, yes. It is also written that fb can use your photos,,,royalty free (among others) however. Meaning no credit or whatever. Bottom line,,,,if my photo is $$$ quality,,I wouldn't post it.

If you signed a release from the event holding them harmless for injury claims to get credentials, you probably also signed a contained statement saying all images are the property of the organization. At least that's the "small print" on the release for motor sports. That's the price for the free food, special access and go anywhere credentials. Sorry, but that is the usual case. The best you can hope for is recognition.

Today I get this link leading to an image I have posted on a website I share with http://www.facebook.com/#!/photo.php?fbid=3530248407747&set=o.193034704128560&type=1&theater. The race decided to use the smaller watermarked file of mine to make it's poster for this weekends event. The watermark is apparently gone, and or covered, there is no credit to me, and they never asked me or payed me. A week or so earlier the same organization released a photo of their poster showing another shot of mine, and did the same thing. While I am humbled, and honored they want to use my images, they are stealing them, and using inferior watermarked images to make them. Not sure where to go with this???
I've included my posted versions along with the posters ACHA has made for the posters.
Thanks for any advice.

I had an ebay seller "borrow" a photo of a camera I was selling on ebay. I contacted him via email and he admitted to using it in his ad because it "looked so good". I laughed it off. This is a whole different ballgame! I like the idea of sending an invoice.

????? I sell pictures for a living.....not in the habit of putting my worst work online although it's debatable if my work is worth stealing or not.

Just watermark, 72dpi and 700 pixels at the longest edge and forget about it.....if you file to copyright your images, then and only then, make your case. Otherwise, go take some more pics and enjoy the craft.

I find it very sad that so much stress has been generated from such amazing photography. I am not at all surprised that these photos were chosen. Most sorry about the fallout.

I know when one is proud of an image you want to share it with everyone but don't put it on facebook! Get a flickr account or create a copyright protected web site.

At least speak with an Intellectual Property attorney, the least they will do is have you register with the copyright office, which you can do yourself. While today it is not necessary to register, before you can take any court action you will have to. Consultations are usually free.
