what you are trying to do is hard shooting at a sky in the background. your sensor is under exposing the bird and tree which is your subject. you want to show the detail on the tree and the bird, unless you going for a silhouette. To do this you have to over expose the picture and then stack it or HDR with one of your other pictures so the sky is not blown out. Hope this helps

Considering your question is only taking one thing into consideration, I'd say the lighter one. The only reason is that the second one looks muddy. Now, if you were to darken the branches and the bird, but leave the sky the brightness of no. 1 that would produce the silhouette effect you might be trying to achieve.

Which one do you prefer. The lighter one or darker one. Or neither. I can take it.

Not necessarily. This image, if exposed properly, could easily be done with one exposure and no need for HDR.

Have you a particular viewer group in mind? I cannot see that the pic, either #1 or #2 will hold viewing attention for more than a couple of seconds. Unless there is something that I cannot see? I also can take it!

To my eye, you need some detail in the bird. I could see none. That is if you don't want this to be just a silhouette shot.

second one is better. It makes more of a point than the other. the other has exposure problems.

Well, if you could bring out more detail on the bird I would say the first one. But since it's so dark I am not sure that would be possible. So now I look at the second one were everything is in silhouette. I like the branches. I would only suggest you lighten that background.

If you could get more detale in the bird in the first one I think it might look nice. that said, the bird is so dark, it might not be possible. I do like the silhouetted branches in the second photo.may try lightening the back ground.
