My beautiful wife sent the cake cutting video to Americas Funniest Home Videos and they approved for the first go around. Now it's on YouTube gaining votes and likes which I figure they use to test the video for potential use on the actual show.

I'm on it I would vote several times if they let me. As for Mogul's question, I dare say it is part of the contract. I have rights to use any of my images for anything I want. I still ask permission to post, but it really isn't necessary.

Yup, in my contract ........... but FYI, the B&G loved it being entered

And, not trying to hijack the thread, but. We also have it in our contract. But, currently working on a deal where a local retailer may use one of our wedding shot in their ads. We would license the use but decided to check with PPA legal on this. Turns out, based on recent court precedent, it is highly recommended to get model releases for this. We are protected but the retailer is not. The implicit release in our contract cannot be transferred to another entity.
Just sharing some recently gained info. I have always had a great interest in copyright, personal rights, and privacy law relevant to photography and have become somewhat of a "goto" person among local pro's. I have also been accused of being a "shade tree" lawyer :roll: :lol: but vehemently deny that.
Off track a little...have you heard that some auto makers (GM) are using the Digital Materials Copyright Act to say that, because cars are now largely controlled by proprietary computer programs, consumers no longer buy a car. Auto makers are simply licensing the use of it to us. Think computer programs where you bought the disc but really were only getting a license to use it. JEEESH!!

Bottom line:
You will notice our name/logo in the lower right corner. When this tiny bit of video goes viral or on TV it has our name/logo. Thus it is marketing material for us and can be used in such a way as we are doing.
Now if it didn't have out name/logo I wouldn't think the way I am .........

Agree!! Just sharing some info that may apply to someone, somewhere in the future. I have found that no matter how ironclad a contract or law may be, some lawyer will find a way to pervert it's wording or intent for financial gain. Thus the DMCA illustration. I guess we all have to be very careful and take the higher, safer road whenever possible. I always like to say "get it in writing".

Don't forget to keep us posted on how the whole thing turns out for you. I'd love to watch it on TV, and hope to see you on there getting the big 100K award. (Then you can get your FF body and 2.8 lenses and maybe something nice for the wife :-)
