Image Release

Hello!

Last week I was in Klamath California which is on the California Oregon border line. We had a sizable snowstorm the day before. Makes thing look great. I saw this very old Ford yellow farm truck maybe 50 feet from the road. Of cause I jumped out and started taking pictures. I was there are maybe 10 minutes and this lady came out yelling and screaming at me what are doing here you are on my property. I am taking pictures of the truck She said I'm going to get my gun and shoot you. Very nicely I told her this is not going to be good for me or you. I wasn't too worried about that. I apologize to her dozen times but it was not good enough for her. $$$. So I got the hell out of town on my trusty horse Tiger.

The point that I would like feed back on is if I use this image on my web site would I have to have a release??? And this story is true other than Triger.

If you were on her property, that puts her in charge. If you were not on her property, legally, she doesn't have a case, so all she could do is shoot you.

What are the chances of her seeing your site? Zero, or less?

Nope.

Items, buildings, etc in plain view, presume no expectation of privacy.
FAIR GAME, that said, I have found over the years that asking permission and offering an 8X10 to the owner almost always sets the tone in a positive light and can think of perhaps 2 ocasssions that I was not graced with the owners permission. I have even been invited in for tea, or coffe on a few ocassions.

No accounting for people. But if you make an effort most folks will see that you mean no harm, are not a threat and are willing to let you shoot.

Maybe this will help or just create confusion.....if it can be seen by the public without having to step on her property and you dont show the license plate....fair game as an editorial piece.....stock wont take them because the car or truck was the main focus and can be identified by the maker.

I was photographing some old buildings in a Arizona ghost town when a scraggly old man came up and asked what I was doing. I said, "I'm taking pictures of that old shack". He replied, "That old shack is my house". I then said, "And it's the nicest old shack I've ever seen".

The law states that if it on private property but can be viewed under reasonable circumstances by the public, and is not a recognizable face or have one in the shot, you can use it for cash gain without a permit. Such as the front of someone's house or a tree in their yard, and I would say, a vehicle in the drive or even parked in a garage with the door left open. However, you cannot not take those pictures on private property without a release and permission, so if you were not on her property, you are fine.

This reminds of the move "Book of Eli" when Denzel Washington gets invited into a home owned by an elderly couple who offer tea and sandwiches with "some meat". Don't accept anything to eat. :-)
