I'm just wondering how many other "hypothetical" issues will get access to SCOTUS?

I wonder why they didn't cite Brown v. Board of Education, when faulty psychological science was used to buttress arguments for the plaintiffs? Or just how is separate, but equal, inherently unequal?

Court cases at all levels are decided on faulty arguments. In U.S. v. Miller, one of the justices decided that the shotgun in question wasn't used by "militia", ergo was not covered by the 2nd Amendment.

Thank you francine for bringing up my name in your idiotic post. I appreciate you using me to once AGAIN show others in The Attic not only what a liar you are but also how you have no ethics or common sense.

You post, "For those of you like Little Denise who think the Supreme Court is always right,..." Show us little francine where I have EVER said, the Supreme Court is always right? Yes, take that as an open challenge to the mindless BS you post here often. I have NEVER said anything like that in my life nor have I ever felt the Supreme Court was always right. The court is made up of human beings and is capable of making mistakes. Roe Vs Wade is one example. The Dred Scott decision is another. Others here have/will bring up even more. But the court is generally able to correct those mistakes.

You want me to respond like a normal person, you tell us. You mean like your form of normality which is not normal at all across America. You lie in your posts, you generally have no facts to bring up and you insult just to be insulting.

The problem herein, is that the Supreme Court usually decides cases on the narrowest interpretations possible. No Court, especially the more conservative versions, wants to wholesale upset our society with overly broad rulings or interpretations of cases or the Constitution. We've had enough of that BS with the Warren and Berger Courts. Everyone seems to forget the reactions to Brown v. Board..., and Federal court orders concerning busing, especially cross-district.

When Roe was decided, it was an opportunity for the vox populi to raise such a stink, that Congress would have been forced to take action to repeal, or at least limit via legislation so-called abortion rights. Had Roman Catholic priests, ministers, preachers, etc., all stood in the lectern or pulpit and kept things stirred up, there wouldn't have been necessary a SCOTUS ruling last year.

In your dreams, there is a history of the leftwing justices engaging in similar behavior including RBG the saint of liberal justices. I don't think that I have to remind you that the impeachment process begins in the House so your current chances are slim to none.

Having said that I did skim through the ruling in the web-designer case and it did not go through the state court system but it did go through the federal circuit. I find it a bit baffling that there was no objection to the origin of the case until after the court ruled against the state.
