Not if Trump remains off the ballot. It would be a vote of judges, not the registered voters in the state.

Judges with the final decision.

Since trump made himself ineligible or disqualified for state primaries according to their interpretation of 14A, then that's on him.

Trump and MAGA sure wanted Obama to be disqualified under the "birther" conspiracy lies--were you screaming "let the voters decide" then, or would you have been okay with Obama being kept off state ballots if conspiracy was correct? I would.

You digress. The point of this is that many of us think the issue should be / have been left up to the voters via a head-to-head vote. I would have been fine with leaving the birther issue up to the voters but, as I recall, it never made it to the ballots so that's a moot point.

But, it's a disqualifier just like engaging in insurrection or rebellion. Let the laws prevail.

I remember the defenses of Trump's behavior at trying to influence court rulings and pressure electoral processes that he should take advantage of all legal avenues available to him. Sometimes you're the goose; sometimes you're the gander.

Your preference (as is mine) is inconsequential to 14A, section 3.

This whole thing is absolute B.S. It's the democrat politicians who are doing everything they can do to keep Trump from being re-elected. They're afraid of him. The only thing they're trying to do is remove republican voters right to vote the person they want in. The tool they've used, the constitution, is so vague in that the person doesn't have to be proven to have committed this only to be said to have done so. Unfortunately the scotus won't see this before Jan 4th when they print their ballots. I don't care who you are or what you believe, this is wrong. Many democrats also feel this way. Even though they hate Trump.

There are questions?

Can they? SCOTUS will decide
Should they? We each have our own opinions on that. There will be fallout and whether it's wise or not will ultimately depend on the consequences of the actions.
