AI... The new limit in porn?
There was a recent thread that transferred to this section that was created, showing a racy sample of what can be done. As I checked its origins (it was too good to be true) I found many like it.
The issue is that all the sample of really young girls, looking underage.
Since the creations are artificial, can they be subjected to the pedophile laws?

Computer-generated child pornography was illegal in the United States, under the Child Pornography Protection Act of 1966, but then in 2022, The Supreme Court struck down that law as a violation of the 1st Amendment citing that the law was too broad.
Unless the law is re-written and passed, there is no federal law that I can find that outlaws AI Porn.
Any kind of child porn should be outlawed. And I'm no prude.

I could not agree more. I once had a long debate with a friend of mine, who is a criminal defense attorney. He had a client charged with possession of child pornography, but all the images were computer generated. He argued no child was harmed. I argued That anyone possessing child pornography is only an opportunity away from harming an actual child. Don’t know if that would stand up in court, but I totally agree with you..

Rabbi, I agree with your opinion, but your opinion and mine mean nothing unless they pass a law that is acceptable to the Supreme Court.
It may be hard to come up with an acceptable law for AI child porn. If it appears to portray young children that is easier, but if they appear to be teens how are you going to decide whether they look like 16 years old as opposed to 18 years old? Actual porn makers like to use 18 year olds who appear to be younger, but they can prove their actual age.

That, my dear "Watson", is the question.
We have a court system, both civil and criminal, where someone has to actually violate civil tort or criminal law to have to respond in the courts. AI is being made out to be some sort of end game, able to see into a person's intentions.
If one looks at AI as an application, and not a "be all, end all". Then what was in the maker's mind becomes a fantasy, albeit it put to the computer. And we've all had fantasies, good or bad. AI is just taking all the inputs available, and offering back what the user wants to see.

I would think it hinges on how one defines depiction of a minor performing a sexual act. Broadly interpreted, it could include drawing. Narrowly, it might not apply to AI. Disclaimer: I’m not a lawyer!

The child pornography laws were developed to protect children. No children are harmed when AI produces an explicit photograph of a child. As of now it is not against the law, ( or so im told dont know for sure)
but it definitely is in poor taste.
My Feilings is it should be banned BUT the person possessing it shouldn't be sent to prison. Maybe a fine and probation.

As we have seen, AI takes many forms today. ie: the genius' at MIT. Or, the auto that can steer itself while you are driving, or Science Fiction Writers. (I refer to the movie, I ROBOT.)
What I am getting at is, in the case of people whose vivid imaginations show what would normally be considered porn, at this time, is not porn at all. Mainly because at this time, AI is from the mind, not the actual. At a future time, maybe yes, AI will be considered porn.
I do not feel that ALL AI is bad, but in certain instances, AI needs to be curtailed. ie: porn. We must weigh AI as it emerges, and at that time evaluate whether it will be good or bad.
I don't know if I am just rambling on, LOL, but these are my thoughts.

Like many things (eg, nuclear reaction) AI is a double-edged sword. Heck, even photography itself can be used for good photos… and porn.
