Trump Authorized National Guard for Jan. 6 but Congress, DC Didn’t Request Its Use

Under the law, a president can't order domestic deployment of Guard; local officials must request it.

A claim by the vice chair of the House Jan. 6 Select Committee that President Donald Trump didn’t order the use of

National Guard troops in the District of Columbia on Jan. 6, 2021, is true because that would have been a violation

of the law.

Liz Cheney told Fox News’ Bret Baier that Trump “never issued any order to deploy the National

Guard to protect the Capitol.”

Trump authorized up to 20,000 National Guard troops for use in D.C. or elsewhere on Jan. 6, but the

use of those troops was later rejected by D.C. Mayor Muriel Bowser and the U.S. Capitol Police.

Under the law, the president can’t order the deployment of the military for use inside the United States.

Liz and company knows the truth.....Trump authorized the National Guard days before Jan. 6, and Pelosi

and Bowser rejected it. Cheney knows it’s unconstitutional for any president to ever order the military to

deploy domestically. He may only authorize their use, then there must be a request.

By her own words, Cheney has cleared Trump of the very thing she has accused him of from Day 1—

an insurrection. Trump never made that illegal order. He followed the law.

CBS news:

Christopher Miller, who served as acting Defense Secretary on Jan. 6, 2021, told the House committee investigating the attack on the Capitol that former President Donald Trump never gave an order to have 10,000 National Guard troops ready that day.

"Not from my perspective, I was never given any direction or order or knew of any plans of that nature," Miller said in the recorded deposition that the committee tweeted Tuesday.

Rep. Liz Cheney, committee vice chair, said in the recording that former White House chief of staff Mark Meadows said in February 2021 that 10,000 National Guard troops were told to be "on the ready" by Miller. Other Trump officials have repeated this claim since then.

CNN: Trump's defense secretary denies there were orders to have 10K troops ready to deploy on January 6.

(CNN)Former acting Defense Secretary Chris Miller told the House select committee investigating the Capitol Hill insurrection that former President Donald Trump never gave him a formal order to have 10,000 troops ready to be deployed to the Capitol on January 6, 2021, according to new video of Miller's deposition released by the committee.

"I was never given any direction or order or knew of any plans of that nature," Miller said in the video.

Miller later said in the video definitively, "There was no direct, there was no order from the President."
We obviously had plans for activating more folks, but that was not anything more than contingency planning," Miller added. "There was no official message traffic or anything of that nature."

Trump has previously said that he requested National Guard troops be ready for January 6. He released a statement on June 9 that he "suggested & offered" up to 20,000 National Guard troops be deployed to Washington, DC, ahead of January 6 claiming it was because he felt "that the crowd was going to be very large."

The committee released Miller's testimony after already revealing that Trump did not make calls to military personnel or law enforcement to intervene as the Capitol attack was unfolding. General Mark Milley, the chairman of the Joint Chiefs of Staff, told the committee that he never received a call from Trump as the attack as unfolding.

Milley testified to the committee that he spoke to former Vice President Mike Pence "two or three" times on January 6. Keith Kellogg, former national security adviser to Pence, also told the committee that Trump never asked for a law enforcement response.

Slo Eddie - I have known so many guys like you. You will reject any logical explanation for anything and accept the least reasonable explanation. If you are told that 2 plus 2 equals 4, you have to insist that the correct answer is 5. You have to spout off the most outrageous conspiracy theories and you somehow think that makes you smarter than everyone else. It does make you different, but not in a good way.

In DC the president is in charge of the national guard. He gives them orders through the secretary of defense. The secretary of defense at the time says it didn't happen. Since you were there when Trump gave the order and know for sure what happened, perhaps you should contact Miller and straighten him out. DC is not a state and isn't in a state, so I don't believe there is a governor.

The two statements do not contradict each other. If the D.C. mayor and the capitol police rejected the offer of troops there were never going to be any troops. In fact, your post actually supports the first post. Summary of the facts is as follows. Trump offered troops on January 2. D.C. mayor capitol police and house sergeant at arms all rejected the offer. Thus Trump never gave a directive to Miller to arrange it.

Thom, read the first post in the link. Trump can not give the order for troops. He can only offer them. If the mayor of D.C. and the capitol police reject that offer then Trump by law is powerless to give that order. That is exactly what the first post is explaining.

Even if you are correct here, which you are not, there are less than 2,000 National Guard troops in D.C. Those are the only troops that under any circumstances Trump could even possibly order to be deployed in D.C. Any other troops would absolutely require approval from the D.C. Mayor. My reading of the law would actually require that approval even to deploy the D.C. guard troops, but there seems to be disagreement about that.

Just read the first post in the thread. It is very clear that the president does not have the authority to deploy troops on U.S. soil.

Of course there were no orders. He could not give that order because the offer of troops was rejected. Cheney and everyone else on the 1/6 committee knows that. It's too bad that they are distorting reality and that the general public is actually believing their claim.

Oh, no. Sean Hannity was lying to his viewers - a lot - 48 times on tv and 43 times on his radio show.

For months, Fox News star Sean Hannity has led his network’s charge to push the flimsy claim that former President Donald Trump ordered thousands of National Guard troops to secure the U.S. Capitol in the days leading up to the Jan. 6 insurrection. This assertion, meant to undermine the Jan. 6 House committee, was pushed by Hannity on his primetime TV show 43 times and his daily radio program 48 times, according to liberal watchdog Media Matters. The committee, however, refuted this claim when it shared testimony from former acting Defense Secretary Chris Miller saying Trump gave no such order. “I was never given any direction or order or knew of any plans of that nature,” Miller said in the video released on Tuesday. “There was no direct—there was no order from the President.” The ex-Trump official added: “We obviously had plans for activating more folks, but that was not anything more than contingency planning. There was no official message traffic or anything of that nature.” Trump, meanwhile, insisted just last month that he “suggested & offered” up to 20,000 National Guard troops be deployed. Other defense and security officials, however, have testified that Trump never asked for a law enforcement response to the attack.

Wrong! https://dc.ng.mil/About-Us/

"This authority to activate the D.C. National Guard has been delegated, by the President, to the Secretary of Defense and further delegated to the Secretary of the Army. The D.C. National Guard is the only National Guard unit, out of all of the 54 states and territories, which reports only to the President."

The claim that he instructed the Acting Defense Secretary to call up 10,000 troops is also false:
