U.S. Capitol riot panel says Trump may have engaged in 'criminal conspiracy'

WASHINGTON (Reuters) -The congressional committee investigating the Jan. 6, 2021, attack on the U.S. Capitol on Wednesday said former President Donald Trump may have engaged in criminal conduct in his bid to overturn his election defeat.

In a court filing — one of the U.S. House of Represenative’s Select Committee’s most detailed releases of findings yet — the panel said Trump potentially engaged in conspiracy to defraud the United States and may have obstructed an official proceeding.

The Select Committee’s members have previously said they will consider passing along evidence of criminal conduct by Trump to the U.S. Justice Department. Such a move, known as a criminal referral, would be largely symbolic but would increase political pressure on Attorney General Merrick Garland to charge the former president and would thrust his department into a political firestorm.

“[E]vidence and information available to the Committee establishes a good-faith belief that Mr. Trump and others may have engaged in criminal and/or fraudulent acts,” the committee said in a court filing.

“The Select Committee also has a good-faith basis for concluding that the President and members of his Campaign engaged in a criminal conspiracy to defraud the United States,” the filing said.

The court document was filed in federal court in Los Angeles as part of the Select Committee’s dispute with John Eastman, a lawyer who advised Trump on a plan to invalidate election results in key battleground states.

Eastman sued the committee in December, seeking to block a congressional subpoena requesting that he turn over thousands of emails.

Charles Burnham, a lawyer for Eastman, said in a statement on Wednesday that Eastman is abiding by his ethical duty to protect client confidences.

“The Select Committee has responded to Dr. Eastman’s efforts to discharge this responsibility by accusing him of criminal conduct,” Burnham said. “Because this is a civil matter, Dr. Eastman will not have the benefit of the Constitutional protections normally afforded to those accused by their government of criminal conduct. Nonetheless, we look forward to responding in due course.”

Representatives of Eastman and Trump did not immediately respond to requests for comment. Trump has repeatedly called the Select Committee’s inquiry a politically motivated investigation.

The court filing included emails obtained by the Select Committee from the day of the Jan. 6 attack, including one where a lawyer for then-Vice President Mike Pence said no judges would endorse Eastman’s legal strategy for overturning Trump’s election defeat.

“Thanks to your bullshit, we are now under siege,” the Pence lawyer, Greg Jacob, wrote to Eastman.

“The ‘siege’ is because YOU and your boss did not do what was necessary to allow this to be aired in a public way so the American people can see for themselves what happened,” Eastman replied.

The committee’s leaders said in a statement that “Eastman’s emails may show that he helped Donald Trump advance a corrupt scheme to obstruct the counting of electoral college ballots and a conspiracy to impede the transfer of power.”

Attorney regulators in California said Tuesday they have been investigating Eastman and whether he acted unethically in his work for Trump. The investigation could lead to disciplinary action against Eastman, such as suspension of his law license.

There was clearly a conspiracy inspired and directed by Trump to stop the Constitutional certification process on January 6th, throw the election results into disarray—-with the intention to throw the election into the courts or Congressional hearings, hoping to change the result in total disregard for the will of the voter.
Trump probably will not be legally charged, but he and Pence, and Eastman, and a handful of other conspirators know the truth, will be remembered in history for the attempted coup.

Clearly a conspiracy? Based upon what? This carefully worded article of maybes and could haves? And the "bullshit" statement on its surface is bogus because we're not given the context of actual statements either before or after it...it's nothing but a rabbit trail from a plethora of directions. The only thing that IS clear is that this is just another haphazard, keystone cop effort to discredit Trump by the same ones who actually DID conspire illegally for more than 4 years to get him out of office through 2 FAILED attempts of non-conviction impeachment. And let's also not forget about Adam Schiff's "ample evidence" of collusion by Trump that, for some strange reason, has NEVER been revealed by him. I wonder why that is?

Read the Eastman memo. Recall what Pence and Navarro have admitted that Trump wanted Pence to do on January 6th. Trump’s intent was too “Stop the Steal” by disrupting the Constitutional proceedings of certification and, in the end, change the outcome of the election. This was his plan, and it was a conspiracy. These facts are not in dispute—one can argue intent only. That is why he won’t be convicted.

You're the one who needs informed. Trump NEVER HAS wanted to win the election by theft or force. What he clearly DID want was for those around him and those who supported him to do whatever it would take to LEGALLY VERIFY that the election results were valid. THAT is what is not in dispute. The only reason that election of 2020 was never responsibly investigated is because there were too many ragtag, scared Republicans who wouldn't go through the process of a legal verification.

Sad that there are still so many who choose to ignore the truth. Maybe Barr’s testimony will be the one to convince the recalcitrant MAGA of their delusions.

Based on Court Documents issued by the 1/6 Committee in an effort to obtain a trump associated lawyer's records which the Committee has subpoenaed!

Clearly, we all know the who[s] & whom[s] lit the fire motivating the Lynch Mob... that would in reality tried and botched the job of hanging the VP of the USA, Pence. Actually, no one’s trying to win you over. The facts are out and no longer up for debate. You either have read the Eastman memo and understand it’s impact or you try trumpsplainig.

The Eastman memo is a very detailed plan which was specifically drafted to find a way that Pence could circumvent his Constitutional duty and not certify the election results on January 6th. Trump fully expected Pence to follow that plan. But, apparently after much soul searching and a talk with Dan Quayle, Pence knew that he could not do what Trump wanted. He has recently admitted “ Trump was wrong”.
Too bad I offended you, but I honestly thought anybody who had read the Eastman memo and listened to Trump and his expectations of Pence, would be unable to honesty say that Trump did want, plan, and expect to stop the certification process on January 6th. That is indisputable—Trump wanted to be President for four more years, and took these steps, and engaged in the Big Lie, in an effort to achieve that end.
