How The Democrats Caused The Port Problems in California

The NEWS says the California port situation is caused by a driver shortage. Not so fast: It is in part caused by a California Truck Ban which says all trucks must be 2011 or newer and a law called AB 5 which prohibits OWNER OPERATORS. Traditionally the ports have been served by OWNER OPERATORS (non union). California has now banned OWNER OPERATORS. Long term, truckers in California are not investing in new trucks because California has a law that makes them illegal in 2035. The requirement is to purchase electric trucks which do not exist. And in the words of Paul Harvey, “Now you know the rest of the story”.

BUSINESS CARB to begin blocking certain trucks’ DMV registrations in 2020. Carriers domiciled in California with trucks older than 2011 model, or using engines manufactured before 2010, will need to meet the Board’s new Truck and Bus Regulation beginning in 2020 or their vehicles will be blocked from registration with the state’s DMV, the state has said. The new “health-based requirements” will need to be met before a driver is allowed to register his or her truck through the Department of Motor Vehicles, CARB says. A new enforcement tool used by the DMV beginning in 2020 will automatically block 2010 and older trucks from registration. Then there's the $5+ a gallon diesel prices in California. We simply aren't going there and paying those prices. Wake up people. Your $20 gallon of milk is coming with your $10 loaf of bread.

Thanks for amplifying the news on the trucker shortage. Ensenada, BCN, Mexico, operates a cargo port. It could supplement the capacity of the two ports in Southern California.

Not correct according to the text of AB 5.

California Assembly Bill 5 (AB5) is a piece of legislation signed into law by Governor Gavin Newsom in September 2019. It went into effect on Jan. 1, 2020, and required companies that hire independent contractors to reclassify them as employees, with a few exceptions. In Sept. 2020, the California legislature passed Assembly Bill 2257, which rewrote a number of the requirements of AB5 and exempts a substantial list of job categories.


California's AB5 expanded on a ruling made in a case that reached the California Supreme Court in 2018, Dynamex Operations West, Inc. vs. Superior Court of Los Angeles.1 In the 2018 Dynamex case, the California Supreme Court ruled that companies must use a three-pronged test (known as the ABC test) in determining whether to classify workers as employees or independent contractors. This test assumes that workers are employees unless the company that hires them can prove the following three things:


The worker is free to perform services without the control or direction of the company.
The worker is performing work tasks that are outside the usual course of the company’s business activities.
The worker is customarily engaged in an independently established trade, occupation, or business of the same nature as that involved in the work performed.

If what the OP says is true, how do you explain the same problem on the east coast, where there is no California and the ports are controlled by multiple states?

AB 5 is what he is talking about, which is a California Assembly Bill. He is also specifically talking about a California set of issues. I've addressed what he is talking about.
I do not know what is causing the delays on the east coast.

I use to own a lot of diesel powered construction equipment. Forklifts, skip loaders, Generators, air compressors and trucks etc. anything over 50 HP was subject to stupid rules. in the old days you wore out a machine and replaced it with new. The new had the "new, improved" engine.Not anymore. The new rules said The engine had to have been build after a certain date or a expensive filter (10 to 20 grand) installed. To clean these filters is another whole story on government stupidity, but thats for another time.
No one came to our aid, we were on our own. Maybe because the manufactures knew they will be selling alot of equipment and parts, who knows. Same thing with our associations, worthless.
We found out the government based their program on junk science and the head of the program was there because he had a fake degree. No one cared about any of that because of "the greater good" cleaner air and all that. They didn't care about how may millions maybe billions had to be spent to satisfy the government rules.
Same people, same mindset that took away our drinking straws.
This won't be fixed quickly because Calif won't back down on their stupid rules. whether they actually do any good or not.
Oh yeah, did you here we are now getting rid of all small gas engines? Don't think just lawn and garden equipment, think how are you going to pump out water after a flood? cut concrete, compact a ditch. Don't say electric because your generators will be outlawed as well.
So you folks wonder what made so many people become so conservative maybe this will help you understand just a little.

Your narrative helps others to see what the rules mean in practice.

I've mentioned before that propane could substitute for gasoline as an alternative fuel. I understand that propane derives from the processing of oil to gasoline. So propane cannot supply all the fuel necessary for modern civilization.

The politics and rule-making here in California arise from the condition of a one-party state. Democrats fill nearly every political position.

Listen up guys. Dick Morris reports that the port bottleneck is caused by union ports that have blocked automation of their unloading machines. The unions are currently holding us hostage by not wanting to automate the ports just like the rest of the world has done. That is a big part of the block-up. Also why change it as it is because now they even get paid not to work.

On top of that the new infrastructure bill in Congress increases the Biden administration provisions in it which give federal benefits only to unionized organizations.
