They must have some special avenue. Unless it's a private avenue I think that's not legal.
It was private and we paid an admission- they had the right. They did not really make any issue beyond the sign. My wife went in and asked if we had to pay - they only asked if I was a pro or not. They did not care what photo gear I had - only if I was going to make some money, they wanted a very small amount. I didn't like it, but thought it to be fair.

I live in SC, at some of the historical places if you are a professional, you have to pay for a permit, to shoot at one place it is $150 a year, but you can go in anytime with people who you are taking pictures with. Some of the beaches you have to have permits to shoot. Some areas you don't have to have a permit.

I volunteer at a museum that does not allow the use of tripods. Twice a year, we have an event (before regular hours) in which we allow tripods, special lighting and special access to some exhibits and (the night before) a tour and three hour class taught by a pro. The cost is $35 per session or class/tour/tripod sessions for $65. This may sound expensive, but consider that most museums never allow tripods. You pay the fee, you get the best shots.
