I usually ask for forgiveness rather than permission. I've never known an innocent photographer to get prosecuted for photographing on a train track (someone will probably look that up and show, I'm wrong).
Just make sure there's no hopping. I don't think there is to much of that going on any more.

The photograph tips the Captain made is spot on as always. I often go back and change problems I have with images after a review. After some time you become better at self evaluation (the time varies from person to person based on ones commitment to excellence and the ability to change what your doing).

One doesn't always hear the train and asking forgiveness it out of the question afterwards.

Railroad photography is an area that has interested me so I have kept up. Roads of all sizes, from the class 1s to the short lines, are aggressively beefing up security-largely because of liability issues.

Russ - Photographers HAVE been fined for shooting on tracks!
There was a thread on the PPA forum a year or so ago in which the topic was discussed and the actual situation was cited. A PDF is attached.

One person asked permission to use some unused track. Here is the reply form the railroad:

"Thank you for sending us your request. Safety is our top priority. We take great effort and expense to educate people to not trespass on railroad tracks. I realize that you are looking for a safe location to photo graph on abandoned railroad tracks. As you can imagine that while you could find a safe location to photograph, people viewing the photos will likely will not distinguish them as abandoned tracks. This could encourage others to illegally trespass on active rail, putting them in a dangerous position. Consequently, we would not be able to permit your request on any UTA-owned tracks. We encourage you to find other locations for photographing."

In any event is is still trespass and often/usually illegal. If caught, you are not "innocent." :-) If dead, you may ask forgiveness from someone higher up than the cops.

Hey captain. I know the law and the risk. I've shot coopers rock hanging over the edge. I think five people have fallen and died. I've shot Morrison spring caves. the entrance to Morrison spring has a sign. "thirty people have died in these caves will you be next".

I'm not disagreeing with you! I don't shoot railroad track shots(I don't cave dive anymore either) Especially on a senior shoot; there's much more interesting places to shoot no matter where you live!

Your point is well taken.

I can't tell you how many parking tickets I've gotten while in New Orleans!
Oh well they're all paid.

I don't have a criminal record... All misdemeanors.....

And one final note.

Don't ever get on a motorcycle... Especially with a camera in hand.

I’ve seen worse senior pictures of people that paid a lot of money. I personally think she should lose the white bracelet and wear a white bra with that top but overall they were nicely done.
