Does loser pay winners legal fees in Australia?
I was wondering what happened to Tony and Chelsea. They were releasing videos nearly every week. Then they stopped. Hope they get back to it.
Years ago, I was 19 at the time, a company used one of my photos for advertising without obtaining my permission first. I had taken the photo for a company and sold them the rights to use it for their advertising. Then, a second company used the photo for one of their adverts. I contacted the company by mail, inquired if they had an advertising department, or contracted that work. They put me in touch with their advertising department. I inquired as to how they obtained permission to use that photograph. Essentially, I asked them to mail me a copy of the agreement. They had none. I then informed them that they had used my photo without authorization.
I mailed them a print of my negative on a light table along with the willingness to go to court over the issue. I was then put in touch with their legal department. My offer to them was $750 for the one time use, broken down as $500 for using the photo and $250 for punitive reasons. I also offered to go to court, but that would necessitate raising the amount considerably. I received a check for the full amount two weeks later.
Some people think I should have become an attorney. My feeling is I don't think I'd like the folks with whom I'd have to associate should I have done that.
As for the Northrops, most of their videos are crap and a waste of time to watch. If either of them told me what time it was, I'd hope I had an accurate watch to determine that for myself.
