I would get a lawyer. I had a local motel ask me to shoot for their brochure, which I did. They told me my photos were trash and they would not be using them. To my surprise they used five of them in their brochure and they looked good. I contacted a lawyer and the motel paid within the week.

This crap happens all the time. The thief tries to shame the victim into going away.

A good lawyer would take care of this problem with a single letter in >80% of cases.

Copyright law is serious stuff, not to be scorned, ignored, or laughed at. Abridging a copyright is intellectual property theft! Just because an image is on the Internet doesn't mean anyone has a right to reuse it. If it's marked with a copyright, the best you can do is to contact the photographer and negotiate usage rights.

This makes me wonder if the photographer had pirated the recordings of the band, removed any copyright marks and then distributed them to promote her photography business. Would the record label owe the photographer a debt of gratitude for the distribution or should the label simply go away quietly? Of all the possible thieves of proprietary artistic product, you would think even a very deeply stoned music artist could get their minds around the self harm of these remarks.

They may just think of all intellectual property as community property... Many musicians don't believe in capital, trademarks, patents, money... But the successful ones do!

Sometimes just threating to go to a lawyer works. I did that with a client, I am an engineer. I got a check and lost a client. Who needs clients like that.

This is pretty funny coming from a music company.

I have a friend who plays in a small-time jazz band. It used to be they'd play old standards, and would tell the audience the name of the tune. Then the music labels started sending around ringers who would document the performance and the company would present a bill for copyright infringement. Now they don't name the tune, and if asked, shrug.

Scuse me but the photog is being way too nice. Get the photos registered with the copyright office and find a lawyer who knows how to write a really scary letter and isn't afraid to back it up. Enough of these jerks who think you put forth no effort or have no rights. Would the record label sit quietly if you were stealing their work? I don't think so!
