my biggest concern is the warranty as in none. say you buy a grey market Nikon lens and it comes with a one year seller warranty. the lens has a problem so you send it back to the seller for repair. who does the repair since Nikon wants no part of it?

Usually someone who once worked for Nikon but went out on there own because they saw an opportunity to make money. There are lots of qualified camera and lens repair technicians out there that work for or own an independent service.
Hasn't Nikon recently changed their policies? They will do repairs for a fee on grey gear, just like Canon always has. Better to make money than turn it down. Something about, it's all made by Nikon regardless of who imported it.

The official word from Nikon is "NO" in regard to gray market repairs. https://www.nikonusa.com/en/nikon-store/gray-market.page . Maybe a shop like Mack can help out here, but best to contact them before even considering a purchase.
If you are looking to save money, you may want to consider a factory refurb from a reputable store (think ABC). These have a 90 day warranty (Cameta extends this to 1 yr with Mack). KEH is also a solid choice for a quality used camera. I've recently seen discounted Nikon kits at Costco with a US warranty. Don't recall which models they carry but worth a look if you are interested in saving some $.

I sent a feedback note to Ebay, suggesting that they require their sellers to state whether their cameras are Greymarket, or not, just because of the fact that companies(Nikon, for instance) will not work on products made for other countries.
