Interesting, but users should not be creating folders in the root directory in the first place. Folders should be created in the user's directory.

Absolutely correct. No reason to mess with ROOT (/) .

Of course even if it's bad practice, it shouldn't result in erased photos. Good that Nikon has discovered and announced the bug.
But really those pics should go somewhere else like /Users/user_name/anything_you_like
(I like ~/Pictures/My_Folder_Name/My_SubFolder_name)
Nikon states the problem occurs when renaming a root folder "using the folder palette of Capture NX-D". So for the stubborn who insist on using / (root) to store photos folders, if they must, they can simply rename those folders using Finder (Apple's file manager), or Terminal, rather than using NX-D to rename the folder.
Nikon also states there is no recovery, but if the unlucky /User has backed up the images properly, then a restore from backup is possible.
Personally, I recommend setting up the file structure using Finder, import using Image Capture, rename using your favorite tool, THEN open NX-D and navigate to the pictures folder. I find it's much easier that way because NX-D is clunky to use for those things. Another advantage, after the photos have been downloaded, filed and named accordingly, then NX-D, or LightRoom, or any other software, can be called to access the photos.
