I see the problem a little differently.

I put the blame on the HIPPA rules.

Here's why.

Please read slowly.

1.) The guy who shot the two TV people was under some form of psychiatric care.
In fact most of these murders are.

2.) Instead of being required by law to report the unstable or downright dangerous persons, the mental health profession hides behind the HIPPA law of non-disclosure.

3.) Every medical doctor is required to keep detailed records, Have tons of malpractice insurance and are required to report espousal abuse, child abuse and any other behavior they deem dangerous.
There is no reason that the mental health profession should not be held to the same standards and requirements by law.

4.) They should be required to report the incidents to the local police dept.

5.) This info should be faxed or e-mailed ( both are legal documents ) and the police should have to send a reply that they received the info from the mental health practitioner within 1 hour.

6.) All background checks usually start with the local police, or should be.

7.) The applicant should have the right to contest the report and be able to review the facts, with a panel made up of both law enforcement and an equal number of citizens.
( best if the person does not know any of the police or citizens on the panel on sight, no friends, buddies or relatives)

Here's the problem, with 50 homicides in a city like Baltimore, I bet not one of the weapons were purchased legally.

Right now the system is a mess and haphazard, it needs improvement.
