Your bird is an American goldfinch. It has a goldfinch
bill not a warbler bill. Their color varies a lot in the winter birds. It is very typically a goldfinch. I re-redid the bird that had the work done on it, reinstating the white under the rump and a bit on the tail as it rightly should have. I will send a picture showing a winter goldfinch

This Goldfinch doesn't just have the duller winter colors, he's immature, was probably hatched this past spring and he won't have recognizable goldfinch colors until this coming spring. He still has baby fluff.

Looks like a white-collared seedeater in its first winter plumage. The problem, though, is that the white-collared seedeater is a tropic species that sometimes gets as far north as the Rio Grande Valley in Texas. Global warming?
After looking at more pictures in my bird books, I believe you have an American Goldfinch. It fits the coloring pattern and the range.
