I have posted 10 at once more than a few times on HedgeHog but I am down to zero now since I read the UHH agreement on submissions. Sorry to rain on everyones parade but Here is the UHH legalese that I cannot possibly agree to in the future.

Visitor agrees as a condition of viewing, that any communication between Visitor and Website is deemed a submission. By making a submission, Visitor grants the administration and the owners of the Website a worldwide, non-exclusive, irrevocable, royalty-free, sub-licenseable and transferable license to use in any way, reproduce and distribute the submission and prepare derivative works of the submission without further permission. This includes commercial and non-commercial use of all submissions, including portions thereof, graphics contained thereon, or any of the content of the submission. Visitor agrees to only communicate that information to the Website, which it wishes to forever allow the Website to use in any manner as it sees fit. "Submissions" is also a provision of the Privacy Policy.

Another tidbit from site's Terms of Service:

The website disclaims any responsibility for the accuracy of the content of this website. Visitors assume the all risk of viewing, reading, using, or relying upon this information. Unless you have otherwise formed an express contract to the contrary with the website, you have no right to rely on any information contained herein as accurate. The website makes no such warranty.

Absolutely nothing wrong with that standard boilerplate disclaimer you refer to.

What is unusually troubling is the UHH SUBMISSIONS agreement that applies when you Post images that is blatantly unconscionably confiscatory (including for their own commercial gain).

As noted in the other discussion, the Facebook terms of service are very similar. The entire 'section 2' is longer, too long to screen capture in one image, so here's a copied portion, including the common approach:

You might want to put on your reading glasses and try again on the FB text ... try words like "create derivative works" and "distribute" and "non-exclusive, transferable, sub-licensable, royalty-free".

I confess that I did not pay much attention to those words in the UHH agreement. I'm not a professional and do not expect or accept payment for use of my images. I am pleased when attribution is given, and I appreciate being asked before giving approval. I am fully aware that once an image has been posted to any public site on the Internet it is not possible to prevent someone from capturing it and using it, for whatever purpose they wish. Since I don't derive remuneration from my photography, my only concern with that would be if someone used one of my images for illegal or immoral purposes.

So far, one of my images has been slightly modified and used as a book cover, and 2 others have been incorporated into travel brochures or documents. (I wasn't asked about the book, but approved it after the fact--no attribution; the other uses requested permission first.) For all I know, others may have been captured and used.

As an amateur photographer I have the same attitude.

The most enjoyment I get fishing is setting the hook. The most fun I have with photography is capturing the image. Catch and release is fine by me in either case.
