They didn't ask for permission because they knew it wouldn't be granted for their hateful propaganda.

Your opinion is incorrect. If I give you permission to use a work of mine, that does not extend to the rest of the world. I have to give permission to ANY user.

You think wrong. Copyright law protects against ANY use of material without permission. Profit-making or not has nothing to do with it. It is entirely up the the copyright holder as to whether and how the work can be used.

Case in point: I knew of a school district whose Parent-Teacher Organization used a Disney tune to accompany a school video for a student function. Non-profit group, school use, no selling tickets, nothing except innocent desire to add music to a student video. This was in Disney country -Orlando, Florida- and a Disney attorney was a parent at the school. Guess what? Disney sued, and won!

It is all in the hands of the copyright holder whether/how a case is pursued.

So, no, just because it has been published doesn't make it 'yours'.


The quote is correct, AS FAR IS IT GOES. A terrific book for many subjects other than its title:

The Copyright Zone; Focal Press; Greenberg and Reznicki

And I'll defer to their advice: Unless you're an intellectual property lawyer, don't make any assumptions.
