The agreement gives him less than he was offered before the shutdown. It severely restricts where he can build anything. It passed both houses with veto proof majorities. If he declares a national emergence he will be shut down by courts immediately. If he tries to move money around the line item veto supreme court decision will stop him. What he can do is lie like hell and claim he is building the wall at record pace. His cult will believe him.

Only Congress has the power quash the President's Declaration, giving that power to the courts is extremely dangerous. If you think different please find a good link and refresh my memories of my Constitutional Law courses which were like 50 years ago.

The Supreme Court stopped Harry S. Truman from taking over the US steel mills. There is one.

$ 8 billion, with no details, no idea where it goes, no estimate of the real final cost, no estimates of effectiveness, and on and on. The $8 billion will be wasted, very little wall will be built, immigrants will stull come and drug addicts will get their drugs.

Thanks. Now let's look at it from today's perspective.


in 1952 No law existed that authorized the President to take such an action, but President Truman asserted that responding to a wartime emergency was an “inherent power” of the Presidency necessary to promote the general welfare, as well as his responsibility as commander in chief of the armed forces. The steel companies sued the government on the ground that the President lacked the authority to take over their industry.

The National Emergencies Act (NEA) (Pub.L. 94–412, 90 Stat. 1255, enacted September 14, 1976, codified at 50 U.S.C. § 1601–1651) is a United States federal law passed to stop open-ended states of national emergency and formalize the power of Congress to provide certain checks and balances on the emergency powers of the President.

The Act empowers the President to activate special powers during a crisis but imposes certain procedural formalities when invoking such powers. The perceived need for the law arose from the scope and number of laws granting special powers to the executive in times of national emergency. Congress can undo a state of emergency declaration with either a joint resolution and the President's signature, or with a veto-proof majority v**e.[1]

The legislation was signed by President Gerald Ford on September 14, 1976.[2] As of January 2019, 58 national emergencies have been declared, and the United States is under 31 continuing declared states of national emergency.[1][3]

The International Emergency Economic Powers Act, enacted in 1977, falls under the National Emergencies Act, which means that an emergency declared under that Act must be renewed annually to remain in effect.



And this from the Washington Post concerning the unlikely event of the Supreme Court deciding against the President. Basically we cannot give the lower courts the power to interfere with perceived National Emergencies, doing that in fact interferes with the powers of the Administrative Branch.

Just like the 3.5 billion that the Fed sent to build the over budget behind schedule high speed rail to Jerry Brown. I seriously doubt that one can say that was a better investment than Border barriers. Are you aware that the I.G. has computed the actual cost of Drone Operation on the Border amounts to $22,225.00 per hour per Drone.

So you are OK with our King doing as he pleases? What is next after this? What emergency is my first thought. He sends troops to the border against the wishes of his military advisers, but yet his base is OK with it. Again where is the crisis that has been far worse in the past? Want to stop i******s, put serious fines/jail terms on any business that hires them! The drugs will continue to come regardless of any physical barrier. We need infrastructure rebuilt far more than a F'g wall!!!!

Congress has stated it is not an emergency, but Trump is now allowed to just do wh**ever he wants regardless? Take away the separations of power from the branches and this tree is going to die!
