Have you sued a spammer?

Is anyone here Sued a spammer? If so, what law did you sue under? And what court did you bring the lawsuit in? Were you successful... How did the case end?

The federal anti-spam law,CAN-SPAM, does not allow lawsuits by private citizens. So I assume people who sued, did so under different law they found… State law or federal law.

Like many of you, I get a mountain of spam even though my ISP block some of it, and I have antispam software. So I'm looking to find a way to go after these lawbreakers.

Tried but had no luck thanks to the CAN-SPAM which preempts most state laws too - leaving the private citizen out of luck for filing...

Nope. It isn't much you can do about it. Other than click for deletion, and say goodbye, and then wait for the next day's batch of spam. I have had, on occasion, legitimate emails get bounced into spam. You can move them. Get rid of the rest of them.

I am getting a second email address on earthlink. I will transfer all of my friends, etc., addresses to the new email address. Along with new new email address, earthlink also gives me three alternate email addresses associated with the main email address. I will use one for things like important places like hospitals, doctors, etc. Another I will use for every other place that asks for and demands an email address. This way my main address should remain free of spam. As it is I'm getting about 200 spam emails/day right now.

I use outlook and there is an option to not allow any mail into the inbox unless the sender is in the contact list - the rest goes to junk mail.
I also use a preview window and select the unsubscribe link which has reduced my junk mail to only a few a week...
It's was a time consuming process when starting, but works after a couple of weeks - and I didn't have to change my e-mail address...

The problem is that some important mail does ends up in the junk mail, so you have to keep reviewing the junk mail. The problem is that you may put an address in one way, but the sender uses another address to send it.

i put all unwanted email into spam every time i check email. usually only one or to a day. i empty spam once a day.. every day... sometimes 75 + .... computer usually catch them first. not a big deal for me. takes seconds

True, but with so few showing up in junk mail, it is easy to check and move to inbox. Since I regularly pull the junk mail to unsubscribe from it, I catch the important ones and update my contacts. Just part of the daily email routine I developed over time.

Except for those who use different addresses whenever they send mail....or for email addresses that are too long to fit on one line. Which means you still have to end up going through the junk mail.
