How do you ever get to talk to anyone for help on Turbo Tax??? I've done my mother's taxes who passed away Feb 8. And I need to know the procedure for filing (eFile hopefully).

You won't be able to efile and will have to prove that you are authorized to file for her. If you do not have last year's tax return you might have to go to the local IRS office to identify yourself...after you have gotten a letter back from them telling you they won't process the return till you contact them.

You need to attach a death notice and court authorization of you as her personal representative.

There is a big problem with criminals filing for deceased people. They watch the papers and somehow get a SS number.

Turbotax can only help you create the return.

I just went through this.

Although I filed a joint return after my wife passed away, I've never filed a separate return for someone who was deceased. It is possible, however.

If you don't have Power of Attorney you may not be able to file. If not I would consult one.

A power of attorney is no longer valid once the person granting it has passed away.

Seek a durable power of attorney.

and that is why I desparately asked on here. I believe, with the help of MtnMan I have solved it. If he's wrong you won't be hearing from me for about 10-20 years. LOL I'll tell Bernie Madoff you said hello.

Yes, the Intuit 'help' function for TurboTax is incredibly unhelpful. If her will named you as executor, then you may file on her behalf. Otherwise, some municipal or State authority must appoint you. Given how close the filing deadline is, get over to an IRS office pronto to seek advice and assistance. You want to avoid 'failure to file on time' penalties. Keep us posted on developments. And good luck.

If nobody files her taxes, will they want to put her in jail? When my mother died, about 17 years ago, her estate barely covered her funeral expenses. No tax form was filed. She left several credit card bills. My brother and couldn't afford to take on her bills, and were not legally required to. We notified the creditors of her passing, and sent them copies of the death certificate. One of the credit card companies was extremely rude and demanding a "certified" copy of the death certificate. I told them it costs $15 (true) to get a certified copy from the county, and I would be happy to send one to them as soon as they paid the $15. I never heard from them again.

Business has the advantage over us. The heirs can be made to pay the debts of the deceased in some cases. Then they get anything that might be left over.

In our case, there wasn't anything left after paying the funeral costs, so the creditors didn't get ANYTHING.
