Ah!!! The good old US of A!!!!
This reminds me of a case where the judge was ruling on what was "lewd and lascivious". The judge was asked to define lewd and lascivious. He said, "I can't define it. But I know it when I see it."
This area of the law, like so many areas of the law is new and continues to evolve. Photographer's Rights, like Privacy Rights, are not casted in stone and the judge will KNOW WHO'S RIGHTS HAVE BEEN VIOLATED DEPENDING ON THE CIRCUMSTANCES.
I remember years ago when I went to Mexico and went sightseeing at the pyramids outside of Mexico City. A person, and mostly men, could stand at the bottom and look up to see lots of women climbing with skirts and dresses. It was very steep and some were even taking pictures of the women. I didn't witness any police or any arrests, but some men have been hounds since the beginning of time.
I've also been to a nude beach in Maui, where a photographer was taking pictures of unsuspecting women laying down or bending over. He had his expensive camera snatched from him and thrown in the ocean by several men that caught him.
Nude beaches are illegal in Hawaii and this photographer wasn't breaking any law. But you go to a nude beach and start taking pictures of people and see what happens. See if you can cry about your rights versus right to privacy. Let me know what happens. LOL

Unfortunately, it seems like there is a separation between legal and moral understanding. While what the "gentleman" was doing was morally wrong, it wasn't illegal.
